US Visa for an Overstayer in UK

US Visa for an Overstayer in UK

If your Passport has been marked with an overstay write up in the UK, will it effect a visa for US.
Even though UK has given the VISA

Yes .. it can. Maybe not.

The length of and reason for the overstay are factors. When was the overstay? What type of visa was overstayed?

The nationality of the overstayer and any other 'problems' the overstayer has been involved in are also factors.

What type of visa into the U.S. is being attempted?

It is a judgment call by Immigration. They can turn you away for no reason or any reason ... which is true for pretty much any country. BUT, the U.S. has been more than unusually particular about it for some years now.

How do they how long someone overstayed

The U.S. government probably does not have direct access to the Brit governments visa & migration records. Certainly not in any sense like the Schengen Zone countries of Europe.

However, do underestimate the cooperation between these governments. If they have reason to look and to ask, they are likely to collect fairly detailed information.

Also: do not falsify your visa application(s). If it is determined later that you did not answer some question(s) honestly & fully, you can get banned from entry for five to ten years, or more.

Jamal, Its difficult for Pak nationals to get US visas at the best of times..I suppose it`ll be even harder in your case as you`d overstayed in the UK for a fairly lengthy period of time...

That's a good question. There certainly isn't any such provision in U.S. immigration statutes. There may be something hidden in the more detailed regulations but I've never come across guidance on the issue of an immigration violation in a third country.

As a Pakistani national however, the consulate and DHS will give more scrutiny to any visa application you file, compared to. say, a U.K. citizen.

If you do make any misrepresentation as to your immigratrion status in the U.K. or any other material statement in a visa application, you can receive a permanent bar to ever getting a visa for the U.S.
