Apply by Post or PEO?

Post by anas123456789 » Mon Apr 25, 2016 9:25 pm

Hey Guys

I am applying for FLRM application for my wife. We initially applied for her FLRFP which was rejected. We then went for an appeal. The hearing date is in June. Her passport is with HO

I have been told that once i withdraw the appeal to make fresh application then i have to do this within 28 days after withdrawal.

since H0 has her passports, is it worth going for PEO appointment?

if we apply by post and for some reason she gets rejected then i understand she will not get an appeal right however will she be able to apply again for flrm inside uk?

In March last year, you wrote in this thread that you were intending to submit your wife's FLR(M) application in June 2015. What happened to change your mind?

hi Casa

thanks for reply

Yes we did not apply for flrm because of income issues. We went for appeal instead to buy time.

Without a passport, this won't be decided at a PSC appointment. What was the reason for the FLR(FP) refusal?

They refused her because we were not able to convince them about the insurmountable obstacles in her going back. We had no child then and we still have no children. We did not apply for flrm then because income was low so flr fp was the only viable option

If you withdraw the FLR(FP) application, submit a FLR(M) application by post within 28 days.

Thanks Casa

i have one more question please. What happens if we send the application by post within 28 days and they reject it for some reason?

i know that if we go through PEO and they reject for some reason then we still put another application within the original 28 day window but how does it work in post?

There's no difference. It's from the date of decision, not the date of application. I'm not convinced that you wouldn't have to the right to appeal if the FLR(M) application is refused....but await further advice from others who may be able to confirm.
