Hi all my ILR has been refused on 10 years basis for Tax discrepancy.

I had made and amendment for 2012 -2013 and and paid everything. But they still refused it and gave chance to appeal. I had applied on 1 day service .

Please suggest what to do and how to prove?

All tax paid for 5 years on self employment and also amended tax paid as well.

I need to prove them that figures are correct and legally it is allowed.

SA302 doesn't get amended for 2012 -2013 but I have requested other payment proofs.

1) Did u fill up the form at PEO and for question 9) where they ask if you are satisfied with your tax returns ?

Did u answer yes or no ? I suspect that you answer yes.

2) Have they given you right of appeal ?

When did you amend your tax return for the year in question - before or after applying for settlement?
Did you have confirmation from HMRC that your tax records have been amended and all taxes that were due have been paid?
Did you include this confirmation in your application (or send it across to HO while your application was being processed)?

It appears you claimed a loss soon after PBS extension!
Amending that would mean you acknowledge that you lied .. rather than it (tax discrepancy) being an innocent mistake!

Maybe that (lying) is sin no. 2 added to the sin no. 1 (tax evasion), hence the refusal despite your attempts to right the sin no 1?

So u declare less income on your self assessment ? or you claim a credit from HMRC for next year Loss's to reduce your tax bill ?
