Tier 2 General Extension - HELP

Post by reduday » Sat Apr 30, 2016 11:40 pm

Hello,

I am on a tier 2 general visa which is expiring may 9 and I'm switching employer for which I will get the new CoS within 16th of May due to RLMT.

Here are few things below which needs clarification:

Is it legal to stay in the UK if I'm making an application in a week or 10 days after my visa expiry date ?

Some of my friends suggesting that I should make an FLR application before my current leave expires and then in the meantime apply with the new CoS, but I'm not sure what reason should I state for FLR application?

Gurus, Please suggest a way forward.

Thanks

It is not "legal" to stay in the UK after your leave has expired. Any stay after leave has expired is "overstay" where in you cannot work.

An out-of-time application (i.e. - an application made after leave has expired) may be processed by UKVI but if refused there will be no right to administrative review.

For purpose of settlement application, overstay (illegal stay) of 28 days is ignored.
Life isn't fair, but you can be!
