ILR Continous residency

Post by hrayrd » Tue May 03, 2016 11:39 pm

Hi,

I am trying to understand how ILR's continuous residency is calculated, and will highly appreciate if somebody can confirm my findings so far. I was also trying to find some consultant or service who can validate and confirm this for some small fee, so if you know any good service please let me know.

Here are my absences in last 6 years.

Year 5: June 2016 - June 2015 - 30 days
Year 4: June 2015 - June 2014 - 30 days
Year 3: June 2014 - June 2013 - 30 days
Year 2: June 2013 - June 2012 - 30 days
Year 1: June 2012 - June 2011 - 160 days
Entrance: June 2011 - August 2010 - 190 days.

So as you can see, last 5 years look more or less ok and i dont have any 12 months where i was away for more than 180 days.

However, the first year when i got the visa, i was away quite a lot. I got my visa August 2010, moved to the UK October 2010 (after 60 days), then stayed till February 2011, left the UK and returned September 2011, after which didnt have any long away time.

So actually, June 2011-September 2011 , which i count for my year 1, i was not even in the UK, but had entered and live in the UK prior that for several months.

Based on all this, do you think i can go ahead and apply in June, or better to leave and wait till September/October?

Let's assume you'll be applying on 01-June-2016 - any absences before the 5 year qualifying period (31-May-2011) are irrelevant.

Reading FAQs for ILR - Tier 1G/Tier 2/WP/HSMP - Read before posting will help.

sorry for late reply.
many thanks for your reply and the link, it was helpful.

One other question please: During this 5 years I had to change my passport, and the old one had been returned to authority. So I cant really remember the absence periods for those dates that were in the old passport, but what I am certain, is that there is no more than 30-40 days of absence for each year when old passport was used.

What is the best way to fill the absences then if i dont have previous passport.

Sorry Hrayrd, don't want to hijack but...

I have similar absence. have you fill up set(o) form, I would be interested to know your answers for 6.2 and 7.13. I appreciate if you can comment on this. you can check my history as follow:
aaatech wrote:History:
01/10/2009 T1G issued
22/11/2009 Entry to UK

24/08/2010 Left UK
after 9 months
15/10/2011 back in UK(since than I've been in the UK)

[Holidays out of the UK - 17 days in 2014 & 24 days in 2015]
Planning to apply in person on **/05/2016

calculating continous residency -

backword count for year-5 start from 18/05/2011 but I return to the UK on 15/10/2011. Do I need to be physically present in UK for full 5 years? Can I apply for ILR now? or wait for 15/10/2016?
During this gap I start working back at home country. is experience letter is ok as evidence?
thanks

Can you please continue in your existing topic/thread as this one is going to start getting confusing with responses as you are not the original poster.

It is unclear which user you are responding to as user 'aaatech' has hijacked/tagged his question onto user 'hrayrd' topic even though 'aaatech' has their own topic, link I have already provided.

ok so coming back to my second question.
I changed my passport during this 5 years, and didnt (couldnt) keep the original one.
So now, i roughly remember all my trips and none of them exceed 30-40 days in 12 months, but there are some trips i cant remember exact dates i travelled. (even months).

Is there any recommendation for this case when i cant really remember all my travels?
