MN1 and ILR BRP after naturalisation - please help

Post by shace26 » Fri May 06, 2016 6:52 pm

Hi All
I am planning to apply for my daughters MN1.

I got my naturalisation on 22/04/16, i havent posted my ILR BRP yet and planning to send it monday.

my question:
my daughter was born on april/2012 while i was in tier-1 and i never applied MN-1, should i keep the BRP with me to apply for my daughter or a certified copy of the ILR BRP is suffcient.

my spouse is still having ILR.

please advice

Thank you
Shace

Where was daughter born?
Where is daughter?

If not born in UK she will need ILR.

If born in UK one parent needs evidence of ILR.

Hi Noajthan
Thank you for the prompt reply.

Daughter was born in the UK and she lives in UK.
i have read few horror stories about applying for kids without the original ILR BRP card.

My spouse still has her ILR card (she didnt apply for naturalisation). should i destroy and send my ILR card or should i send a email to homeoffice explaining my situation, or my naturalisation and my wifes ILR card is sufficient for my daughters MN1?

I am planning to applying for MN1 for my daughter next week.

Thank you
Shace

Apply for daughter with wife's ILR BRP card.

So it's a Section 1(3) entitlement that your daughter is blessed with.

Some members have reported caseworker error in such cases.
You should ofcourse be able to use mother's documentation.

Suggest a belt and braces approach...

Hold onto your BRP for now.
Apply to register child via NCS who will submit official copy of all documents.

If you (/NCS) decides to submit your documents (rather than wife's) then so be it - you can mail HO separately about hanging onto your BRP for this specific reason.

Wait and see what happens with application.

If any dispute or query from HO you have concrete proof of your prior settled status (to complement whatever HO has on file about you).
When all is done and dusted you can see about disposing of/returning your BRP.
