ILR Application

Dear Friends/Respected board members,

I want to know what is the earliest time I can apply for ILR.

I made my first entry on my Tier1-General visa in 9 Sep 2011 for a interview, and then went back to my home country. I just stayed for two days in Sep 2011.

When I went back, I got an offer letter from the company and joined in 11 Nov 2011 and since then have been continuously living in UK and paying tax.

The entry stamp on my Tier-1 General visa is Sep 2011, however i started job in Nov 2011. Which date should i use as a basis to apply for ILR?

Also, am i correct to assume that i can apply 28 days before the eligibility date?

I appreciate the help of respected board members.

Dear Friends/Moderators,

I have gone through the details and have been browsing forums over forums and still cann't figure out if I should apply 28 days before 09 Sep 2016 or 28 days before 11 Nov 2016.

I am really sorry but perhaps i am not very good at this legal language. Any help will be appreciated.

From Sep-2011 as mentioned in FAQ Q4 but ensuring that "you fulfill Q20 continuous leave criteria" when out of country Sep-Nov 2011 gap counted.

Let me clarify that a bit more.

I received Entry Clearance in 2008, but did not enter until Sep 2011. Upon entry in Sep, i stayed a couple of days before leaving.

I returned after almost 2 months in November 2011.

Based on the advice of respected board members, i understand that i will use the Sep 2011 date as the reference point, and can apply 28 days before Sep 2016.

Please let me know if this is incorrect. I don't want to spend £8000 pounds, only to realise that I applied at Incorrect date.

However, in the ILR guidance it states that the Absences must be for a reason consistent with the original purpose of entry to the UK or for a serious or compelling reason.

Since I am a Tier-1 general migrant, do I need to give reasons for the 2 month absences, or can i just count it towards the 180 day limit.
