10 years long residence application (qualifying period)

Post by xiongmao233 » Fri May 06, 2016 11:38 pm

Hi all,

I am preparing 10 years long residence application. i am confused by the interpretation of the '28 day before qualifying period'.

I arrived in the UK on 30-Sep-2006. Counting from 30-Sep-2006, as it mentioned in guiding notes that I can apply 28 days before completing the 10 years qualifying period, I am wondering if it means I can apply on the 2-Sep-2016 (9 years 11 month 2 days) without further valid visa requirement (e.g. current visa valid till 5-Sep-2016), or does this also require a valid visa until 30-Sep-2016 (10 years) but you can apply 28 days earlier than its expiry day?

Many thanks for any of your advice,

Cheer,
Dan

28 days before reaching 10 years, provided you have valid leave at the time of application. Apply in person for a same day decision if you wish.

Thanks CR001,

Will this have any risk as the total qualifying period is 25 days less than 10 years?

Many thanks,

The policy allows you to submit an application 28 days before the 10th anniversary of your legal stay in the UK.

Thanks Geriatrix.

Thus in my case when would be the earliest day i would be able to make the application in person 2-Se-2016 or 3-Sep-2016 (entrance day 30-Sep-2006)?

Many thanks,
