How does a dependant effect a main applicant for ILR?

Post by Siggi » Thu Jan 03, 2008 10:49 am

I have a confirmed appointment for my ILR on the 25/01/08.

As the main applicant, I arrived in the UK on the 11/02/02, so applying for ILR on the 25/01/08 is no problem.

But my wife, who is my dependant of my visa and she arrived on the 14/03/02, could be a issuse and may be rejected, for applying too early.

Any advise on this this?

Don't worry. It's not a problem.

As I understand, you will get ILR and your dependants would also get ILR as dependants (even if they arrived after you). After this, each one would be independent (they hold ILR by themselves) and can apply for BC when they want after 12 months.

Guys thanks for the replys.
I also made a mistake with my arrival dates, it is in fact 11/2/03 and my wife's arrival was the 14/3/03.
I really dont want go down to Croydon spend £950 for ILR only to be told that I qualify, but my wife needs to apply again in 30 days.

As long as your wife holds a dependent visa, she will get ILR. My wife got ILR along with me after being in UK for only a year and half.
