Hi all,

My Friend and his family background as follows:
His wife first Entry Clearance from India 13th Nov 2010. TIER 1(POST STUDY) PARTNER.
and extended on Dependent TIER 1 (GENERAL) In the UK 23rd Feb 2011
She left the UK 09th July 2011
Child born in INDIA October 2011

Mother and child applied for Entry Clearance as a TIER 1 (GENERAL) PARTNER from INDIA
3rd March 2015 both are living together with my friend in UK since MARCH 2015

Present both got FLR(M) 5 years Partner route
wife on Spouse/Partner Visa
Daughter on Dependant Visa
Leave to Remain.

My friend he recently got ILR in (May 2016) through Tier 1 (general) 5 years route
he applied his wife FLR(M) along with child who born in India.
finally his wife and child got FLR(M) 5 years visa recently.

We learned that child born abroad before either parents settled in UK should need to get ILR first and then apply for MN1 under section (3) for Registration as a British Citizen. if this is yes then

my friend's child can immediate apply for ILR or should have to wait 5 years then apply for ILR.
Please gurus help him with your experiences and knowledge.

Wait.

Overseas born child is expected to have ILR before registering for British citizenship.

Child is not eligible for ILR before mother.
