Need help! Liability order considered CCJ?

Post by mike1628 » Wed Jun 01, 2016 1:48 am

Hi everyone.

My wife is applying for a FLR(M) this week.

However we have one problem. Last year when we were out of the country, our council issued us with a summons to court for not paying the council tax. We did not know about this and it escalated to her being issued a liability order after the court date. When we arrived back in the UK we immediately went to our council and paid off all the council tax and court fees.

Now on the application form, is the liability order considered a county court judgement or a civil penalty?

I've read through the forums, and some said that the LO is not a CCJ nor CP, and that she does not need to declare it.
However, other people have said it is best to declare.

What should we do?

Please answer soon as we need to send off the form this week.

Thanks in advice.

Also, my wife is 6 months pregnant.
Should we note this on the application form on Section 8B: Other Information?

Would it help our application, or better to leave the info out?

Thanks again.

It is not a CCJ. It is issued in the magistrates court.

That's great, but do we need to mention it at all?
Will this affect the Good Character standing?

If it is paid it is fine. You can mention it in the 'Additional Information' page briefly and that it was paid in full.

Oh, and carry the proof of payment in full with you, just in case.

Do you mean attach it with the application form?
Should I attach the liability order as well?

When you said briefly mention about it in the Additional Information page, which page is this? I can't find it in the form. The only page similar is the Other Information page at Section 8B, which is several sections before the court judgement section.

Thanks.

Thought you were applying in person. If not, you can write a short covering letter explaining but I don't think it is necessary. It is not a CCJ and should have no bearing on a FLR(M) application anyway.

No, I'm posting the form.
So I don't need to mention it at all?
That's good.
Thanks.
