ILR on the bases of Discretionary leave to Remain

Hello

my wife is due for ILR next month on the basis of "Discretionary leave to Remain". i am a British national while she has also completed her 10 years lawful residence as well.

can you advise me following

1- which documents are required to attach with application
2- if she need life in the UK and English test certificate
3- can she apply on the window ( same day service)


will really appreciate you help.

There are different requirements depending on which route she is using to apply for ILR.

So is it ILR through 6 years discretionary leave to remain on Set(O) or is it ILR based on 10 years long residence on Set(LR)?

thanks for your prompt response CR001

she got both options opened , but most likely will go for " ILR through 6 years discretionary leave to remain"

as i heard ( i am not sure) this route doesn't need LIUK & English test for ILR.

I think it does require LIUK but not English.

If the first Discretionary Leave was granted before July 2012, which I think it would be in your wife's case as she has been on that visa for 6 years, I believe she does not need LIUK or English

And I think it would be much easier going for ILR based on 6 years leave as the evidence documents needed would be less compared to going via the other route.

Feel free to correct me if I'm wrong.

You will need:
Cover letter explaining you are applying for ILR based on 6 years DLR
Valid Passport
Current BRP card
Previous Home Office grant letters
Cover letter from you explaining your wife reside with you and you and share accommodation etc
Cohabitation docs(NHS card, Polling cards etc)
Accomodation evidence (council tax, tenancy agreement etc)
Bank statements
Payslips, P60s
UK Degree certificate if she has one
