Hi all

I am a full-time employee but also am the Director of a Ltd company as I make craft items and sell them online as well as a side-business (less than a year old).

Sections 1.45-1.48 asks you if you are an employee or a Director. I am obviously both, but the subsequent sections only give you space it seems for one "name of employer or business" and one "address of employer or business".

I am happy to inform the CW of my small business (which I hope to grow over time), and obviously have nothing to be ashamed of, but am unsure how to disclose it, given the form isn't written with my situation in mind.

Any thoughts on how best to proceed?

Its a generic and poorly-designed form.

Suggest add your explanation as a cogent paragraph in the additional information section at end of form,

I suppose because I am not due to pay any tax yet on the previous 15-16 tax year (the private Ltd company was set up in November 2015), I have no requirement to show a "Statement of Self Assessment" yet for it (due to being a company director)?

[Incidentally, the company made a loss anyway due to set-up costs and little/no income, so the point is moot, I'm just wondering if they will expect to see any paperwork if I apply this July]

You must have some documentation indicating the company exists, use that.

No - I am thinking ahead to naturalisation. Due to marriage to British citizen, I can apply straight away following ILR. This is a separate question specifically regarding the AN form.

You must have some documentation indicating the company exists, use that.
Yes indeed - Certificate of Incorporation.

Based upon the date of incorporation, there is no need to file for self-assessment for the 15-16 tax year until 31 October 2016, after the date of application for naturalisation (slated to be July 2016). There is also no CT liability until 2017.

Well you can then show company exists and explain why no accounts are available.
If caseworker is interested, you've covered it as best you can.
if not they will just disregard that document.

Here's an interesting follow-up to this.

I have now received ILR and am ready to apply for Citizenship (spouse is British).

Tax Year Runs from 6 April 2015 - 5 April 2016
Company was formed 16 November 2015 and started trading
I am a Director of that company and therefore must register for self-assessment

My deadline for registering for self-assessment for the 15/16 tax year is 5 October 2016
My deadline for filing my self-assessment and paying my tax for the 15/16 tax year is 31 January 2017

If I apply for Citizenship now, do I need to sort out and file my self-assessment before doing so for the 15/16 tax year, even though it is not due yet?

I should stress that I am specifically asking regarding self-assessment here for the 15/16 tax year, NOT corporation tax or annual accounts for the company, which has been trading for less than 1 year and therefore has no first year accounts and no first year tax liability yet.

Guys I appreciate that this is a technical question, so I have asked the question on a specialist accountancy website forum.

The answer from the gurus there is as follows. I will just leave this here for the future benefit and reference of members who may be searching on this topic:
There is no legal obligation for a company director to register for self assessment. If you are registered for self assessment and the company has paid you nothing, then you don't need to put anything on the self assessment form.

SA103S is for self employment. You don't need it as the Director of a Limited Company.

Corporation tax is for your limited company to pay. It has zero effect on your self assessment.

You will only need to fill out self assessment IF either:

a. You pay yourself a wage as the Director

or

b. You pay yourself a dividend as the Owner

Sorry to clarify - "a" above is incorrect.

If you pay yourself a wage as a Director of a Limited Company, the tax for this will be dealt with via PAYE, and therefore you have no need to perform self-assessment in this case.

Only if the Dividends you pay yourself exceed £5,000 in a year do you actually need to do self-assessment as the owner/Director of your own Ltd company.
