Qery regarding time spent during the Appeals

Just a quick query if someone can help me out here .
I Applied for tier 1 entrepreneur extension at the end of January last year , Home office refused us and we put an appeal to challenge the decision had the hearing in first tribunal last year December judge gave the decision in our favour but on 20 January 2016 home office filed an application for appeal against the decision that has also been overturned by the first tribunal in June 2016.
My query is that the time spent in this whole period would it be counted towards my five years as in the tier 1 visa category and will I be able to put in ILR application if this time is included .

or do I have to wait another two years once home office grants me the visa extension.

Any help would be highly appreciated .

No you can and should apply when you spend five years on tier 1 entrepreneur visa to be eligible for settlement.

Yes u can
But you will show 2 employees for 12 months

i have five employees working for me and they have been with me for more than 4 years now

You need to show that after extension you
Have still these employees and one current appointment reports for settlement that's it.
Job done when completed five years from the first date of your initial visa tier 1.
