Do they really carry out checks for ILR

Post by dipco15 » Thu Jan 10, 2008 7:47 pm

Do the case workers really carry out criminal conviction checks for ILR or is it randomly done from person to person?
From reading other peoples experiences they received ILR within a few hours so how are the case workers expected to check everything, eg, taxes, paye, credit checks, absences, employment history, absences, etc

I am sure they are definately done for naturalisation but are they carried out in depth for ilr.

I believe it is random, but checks are happening more often now.

If you are asked to declare criminal convictions for ILR and you don't, then your ILR (or British citizenship) can legally be revoked later on if they do find out.

All it takes to check if someone has a criminal record in the UK is a check on the Police National Computer (PNC), which caseworkers in the Home Office may or may not have access to.

If you don't declare your convictions and you successfully apply for ILR you'll be looking over your shoulder for the rest of your life.
In a few years time we'll look back on immigration control like we look back on American prohibition in the thirties - futile and counter-productive.

They don't have access to the system, which is why they can't find out about cautions, but they can easily make requests for info on convictions, and they often do.

Also, lets say you lie about it and get away with it. Brilliant. Then, when you apply for citizenship they check, find out you lied...and strip you of your ILR and ship you home. Not worth it.

Home Office caseworkers and Immigration Officers, as Victoria said, don't have DIRECT access to the PNC but they certainly have authorisation to request information held on an individual on the PNC. In most cases it takes nothing more than a phone call and a few minutes for any info on the PNC to be available.

As said by Victoria, if someone slips through with their ILR application theyre probably going to find out at citizenship application time.

ILR applications are often decided in minutes but citizenship applications take weeks or months. I'm pretty sure the backlog isnt the only reason.

Thanks to everyone for your great advise regarding this matter

Re government departments - when in doubt it's safer to work on the premise that they do have access. Especially when playing for high stakes.
