Eligible for ILR?

Hello All,

Hope you doing well.

I'm on a tier 2 general visa. My current visa is valid till 25-08-2016

Date of Visa Issue : 22-09-2011
Date entered UK : 19-12-2011
Current Visa valid till 25-08-2016

As per ILR terms one can apply 28 prior to the date of Eligibility.

Whats the earliest date I'm eligible for to apply for ILR.

I want to confirm with the experts in the group, if I'm eligible to apply for ILR Or I need to go for extension.

Did you mean 22-09-2016? If thats the case, as you mentioned 28 days before this date, could you tell me what's the earliest date I can apply?

Thanks Vinny. That explains I don't need to go for extension.

Another Question: If for some reason the visa is refused and I had to extend my Tier2 visa, do I get a grace time to do this as my visa is expiring on 25th Aug 2016. And will this time cause a break in my continuous residence?

ex: 25th Aug 2016 - Visa Expires and I applied for extension on 26th Aug 2016 (in case my ILR rejected), will this 1 day gap cause break to continuous residence?

You are usually allowed overstay of upto 28 days from the date of visa expiry, provided that has justification that you might have to explain on the second application.
