Child born in Canada to Tier 2 parent

Post by Steploye » Thu Dec 31, 2015 10:41 am

Help needed,
I am currently a Tier 2 visa holder, my wife (Tier 2 dependant) gave birth to our son in Canada. I am wondering, can my son enter the UK since he is visa exempt as a Canadian citizen and then I apply to the Home office as my dependant when he is in the UK or do I have to put in the dependant application before he can be allowed to the UK.
I am confused as to what to do, please do kindly help.

This one.

Switching to any visa within the UK as a visitor is not permitted. Even though a Canadian is visa exempt, it is still being admitted as a visitor and just means they don't have to apply for a visitor visa before traveling.

Agree.

Child should apply for entry clearance as a Tier 2 family member. Cannot switch from a visitor to dependant status in the UK because 319H(h) would fail.

Hi

I hope you can help me.

I have a similar, slightly more complex, situation. I am Tier-2 worker in Uk and my wife has given birth to our son in Canada. My wife has Pakistani Passport and my son has Canadian passport. I need to apply the dependent visa for them. Both my wife and my son are in Pakistan now. I know my wife needs to apply from Pakistan for tier 2 dependent; however i am unsure about my son. Being a candian passport holder, does he need to apply from canada or can he apply from Pakistan??

Kindly comment
