Is my wife has to appear in the IELTS exams again as well ? I got your point that she has to get her TB test renewed.

Brother MGH the most important thing I would like to ask you is about the IHS as at the time if my wifes visa application the IHS was not in place and I have won the appeal on the basis on my previous application when IHS surcharge was not in place.

Many thanks and waiting for your useful replies.

please remember me in your prayers and I'll also pray for everyone in my every single prayers.

My appeal was processed on 11th may 2016
i recieved my notice around 20th june
deadline 6th October 2016

i am sure i would be able to win the appeal even if that means going to court. The mp assistant told me what the home office said to them which i dont understand how they could say that if they did not go through the supporting documents again. i think they was just making things up. they said they have done this for 10 years and im the first person they come across who is in this situation.

Salaam all. My wife received an email from global emails asking if we would like to continue with the appeal as we recently sunmitted a new case. if we comtinue would that has an adverse effect on the new case? However if i was refused a second time does that mean i have reappeal and close both the first appeal?

If you have submitted new application you will need withdraw the appeal and in new application you should of provided the reference number also hope you have expalined how you meet your financial requirement for whatever reason the 2nd case gets refused then unfortunately it's back to square one and you will need appeal on the reasons of refusal on that application (2nd application )

You can't have appeal active if you submitted new case because if the second application is refused he can not go back to the 1st appeal pending that's why it needs to be withdrawed

@sidrakhan

You are wrong.

You don't have to withdraw your appeal while making a new application.

Check the link below and read number 20.

Dont be harsh on her. She is probably confusing in country(further leave to remain visa) and out country (entry clearance visa) application . A person who is on section 3C leave after making in time application within UK cannot make new application while his appeal is outstanding . A person who has an appeal pending can make a fresh application for entry clearance in the same or any other category. There is no requirement for a person to withdraw an appeal.

Aoa to Everyone,

By the Grace of Almighty Allah My lawyer has finally received today a written decision from the Courts. Sad thing which I have understood after reading the letter is that I have to wait for another 28 days before the BHC Islamabad will give a call letter or before my wife will receive any kind of email from them but anyways Allah Ka Karam Hay for receiving this. I have waited 4 years for that so another 28 days wont be much of a difference to me.

I just wanted to get some kind of input from the respected members that when will I be able to find out that what exactly my wife has to submit when submitting her passport will I get notified by the Home Office to submit a New TB certificate or God Forbid another IELTS as well ? How long more will it take once the 28 days period is lapsed to get a call letter or an email as I know very well that how good BHC Islamabad performance is which is just commendable.

Waiting for your useful replies.

Please remember me in your prayers and I'll also remember everyone in my every single prayers.

Kindly keep us updated on the forum with the outcome of your spouse visa applications/appeals.

Good luck to everyone.

My appeal deadline was 15july and until now no response from them. I sent an email to tribunal n there reply was this..

To date the respondent (Embassy or Home Office) has not overturned their original decision, therefore the appeal will progress through the appeal process.

As you have requested your appeal to be dealt with at an oral hearing, an IA30 (Notice of Hearing) will be sent to all parties in due course.

No further action is required from you at this stage.

Please quote your Tribunal Appeal Number in all correspondence when contacting us, as we may not be able to assist you without it.

Please note that we are unable to provide timeframes for the appeal process (as a whole or each procedure within the process) due to a number of varying facts.

What it say not overturned is it means they had Reviewed it.? What others get in email reply when deadline already passed. Is there any hope...

An IA35 (Papercase Submission Notice) was issued to all parties on the 22nd June 2016, requesting that any additional evidence must be received by the Tribunal no later than 18th August 2016.

If you have no further evidence that you wish to submit, no further action is required from you at this time.

If you have received an IA12 (Rule 13 – Filing of Documents) with your Notice of Hearing, this has been sent to you for information only, as it is a reminder to the respondent that we have not received the Respondent Bundle.

As you have requested that the above appeal is to be determined on the papers submitted, the Tribunal is unable to provide you with a specific date when the appeal will be decided by a First-tier Tribunal Immigration Judge.

You will be notified in due course of the Judge’s decision.

Please quote your Tribunal Appeal Number in all correspondence when contacting us, as we may not be able to assist you without it.

Please note that a Sponsor is not entitled to a copy of the Judge’s decision. If you are a Sponsor and wish to know the reasons for the Judge’s decision, you will need to contact the Appellant/Representative for these details.

Please note that we are unable to provide timeframes for the appeal process (as a whole or each procedure within the process) due to a number of varying factors.

Hi this is an email
My cousin has recieved
They have asked if they would like to add more paperwork
And this is an paper appeal

And there fore refuse under paragraph Ecp-1.1 (d)
On financial requirement paragraph it says that sa302 form and payslips were provided. Eco acknowledged that a sa302 form provided shows warning of £21k however this is simply based on the information provided on self assessment in the knowledge he was required to earn £18600 for the purposes of your visa application. This does not independent corroborate that your sponsor has actually earned this figure, and in the light of above discrepancies I am not satisfied three tax payments satisfactory establish that your sponsor is employed as it claimed.

I therefore refused your application because I'm not satisfied, on the balance of probablities that you meet all the requirement of the relevant paragraph of uk immigration laws.

I hope this will give you idea.

Thanks
Dear all,

I re applied for my wife's spouse visa second time in April and just received a refusa second time. This time they refused only on financial grounds as it mention I didn't submit payslips from my employer even though I did submit P60 and a letter from employer along with sa302 form for last two years stating my income as 21k and 18796 respectively. On self employment they wrote the same line as my earning only based on information provided in sa302 which does not independently corroborated has actually earned that income however I did also submitted all evidence of invoices and my bank statements from my self employment.

Now I would like to ask which option will be better and quicker either to appeal or re apply third time with priority service and what will be the chances of getting successful visa.

Thank you

You should make a new application and submit the missing/required documents with it along with all other documents. This is clearly your mistake that you omitted these very important documents.

Thanks kimak for replying but I don't know which documents are missing as P60(as employment ended 31/03/2016 n also mentioned in employment letter) was submitted from employment which shows full year salary along with letter from employer. And from self employment all invoices and bank statements showing all relevant receivings of invoices plus sa302 for past two years and a letter from accountant. So what else was missing to prove my income. Please elaborate.
