Hello All,

My post study visa was from Jan 2011 to Jan 2013 in Dec 2012 i have applied for TIER 1 Entrepreneur Visa.

Visa was refused in May 2013 but i have received refusal letter in July due to Royal mail delay.

I have lodged appeal with royal mail tracking id and my appeal was considered as in time appeal.

Letter dated 11 November 2013 (Determination promulgated 20 November 2013) appeal was dismissed by lower tribunal but i was given chance to continue with higher tribunal.
But i had left UK on 10th December 2013.

Currently the company which i am working is processing me TIER 2 ICT short term visa

While filling the online application i see option
Have you ever voluntarily elected to depart the UK?

Could some one please let me know what can i mention , when i select yes it is asking for immigration decision/papers i am not sure what to mention.(As i left UK when i had chance to continue my appeal with upper tribunal hence not sure of immigration deciison)

Also appeal dismissal from lower tribunal is dated 11/11/2013 and determination promulgated date is 20/11/2013(this date is in stamped format) , i understand my 28 days to leave UK is from 21/11/2013.
As i left on 10/12/2013 hope i have not over stayed , please some one advise on this.

When you left the UK you were within the 28 days grace period so you should be ok.
You answer no to voluntary departure as that is then you have been served a removal notice and go under your onn costs etc without the HO actually removing you.

Many thanks for advise frontier mole.

Tommorrow i have my visa docs submission and i have choosed "Yes" for volutarily departure.
I just read your reply i'm worried now , could you please advise urgently.
Shal i enclose my first tier tribunal appeal dismissal papers with my application so that they can know that i was not overstayed.

I have submitted documents and application on 24 th June , still waiting for decision.

But one thing doesn't allow me to sleep is i did not mention the reason why i stayed nearly 20 days after the appeal determination. HO people delayed a lot after numerous phone calls finally they took 20 days to arrange passport at my port of departure.

I also dropped mail to HO during my 20 days stay after appeal determination asking to arrange passport ASAP as i want to keep my stay legal.

Should i have included this email in my application ?

I am just worried if ECO wud reject saying no material facts included for 20 days stay.

Your visa will not be refused because you took 20 days to leave the UK. The ECO has full access to your UK immigration information and can see your history. You left within the 28 day grace period so there is not an issue.

That does not mean your home and dry as it may be refused for other reasons. But this is just a note of caution not because you have mentioned anything of concern.
