I am on indefinite stay and my wife have been my dependant for last 5 years now. I will have to apply for her spouse visa. We have 2 children.

I am confused regarding the below

1. I have just got a job which is cotracted £25k per annum. Can i show this contract on evidence of my earning as this is what i have not earned yet this year and will be earning next year in this new job as contracted.

2. Or i have to use the earnings that i have already earned from last years job. And as i have done over time it will not be necacssary that i will earn the required amount next year aswell.
It might be less depending upon my over time. As my last year job that i have just finished was a zero hour contract but my earnings are more than 24k lasst year.

3. Can i include the over time and extra hours that i have done and it obviously shows in the payslip.

4. Do i have to show last 12 months payslips or 3 months will do.

5. Do i have to show maintain any specific maintainance funds balance in my account for last 3 months ???

6. Is attaching a emplyers letter is a must??

Please any suggestions

On what basis did you obtain ILR (10 years long residence or 5 years as PBS migrant)?

10 year long residency..my wife is in uk with me on dependant visa since 2010 when i had my psw. She is still my dependant and her visa expires june 2016. Plz advise

As the rules changed in 2014 for PBS dependents, she will have to apply for FLR(M) which will a 5 year route to ILR (2.5 + 2.5 years). Unless before that she reaches 10 years when she can then apply for ILR under Long Residence.
Her immigration clock was set to zero when your applied for your own ILR under LR. Her previous time as your dependent isn't counted. She will also have to pay the NHS surcharge of £500 in addition to the FLR(M) visa fee.

You need to show the earning in the 6 months before applying and it must also be ongoing employment (or new employment).

If you have changed jobs, you should submit 12 months payslips and 12 months bank statements. If you have been in the same job for at least 6 months and still in the same job, then it is only 6 months of each. 3 months payslips and bank statements is NOT enough.

You need to prove a minimum of £1550 per month.

There is no maintenance fund requirement for FLR(M).

You need an employer letter.

Also please advise my bank is in over draft for last few months and salary comes and goes.. therefore the balance is in minus all the time. Is this an issue as well. Any minimum maintenance requirements??

Not an issue with overdraft, the bank account which my salary is paid into is often also in overdraft and this caused no issue with either spouse visa or recent flrm extension. They want to check you are receiving the salary you claim so it is probably best to highlight/point to payments on your statements!

I am going to apply for my wife spouse visa from UK as she is here and i am settled under 10 year rule. I have 2 children. Both born in UK. One born before i got indefinite and 2nd born after i got indefinite. They both will be british now anyway.

My question is do i have to show £18600 earning requirement for my wife spouse visa or £24800 as i have 2 kids as well but i will be only applying for my wife spouse as kids are british now anyway.

I am on same boat hope experts on this forum will advice me smoothly.

I have 2 jobs and applying under Cat A, First job been doing couple of years and second job started in April 2016 and will be applying for visa in October.

Both jobs are zero hour contract.

Earnings as follow:

Job 1

September 2016 - £2130 ( paid Holidays)
August 2016 - £1300
July 2016 - £1602
June 2016 - £1031
May 2016 - £1347
April 2016 - £858

Total Gross: £8268 According to calculation:: 8268/6 X 12 = £16536


Job 2


Started in April 2016 and first three months did not work and my employer is happy to give me letter stating my contact hours and job confirmation when it was started.


July 2016 £700
August 2016 £800
September £700

Torak Gross: £2200 According to calculation:: 2200/6 12 = £4400

6 Months total earnings as per calculation will be : £8268+£2200 = £10468 or as per yearly earnings will be : £20,936


Please comments if that will satisfy it.

Yea your calculation is correct .

Job A + Job B will be your total annual gross salary i.e £16536 +£4400 = £20,936
