EEA FP - not necessary to complete form and supply all doc?!

Post by KarmaPolice » Thu Jul 21, 2016 10:24 pm

Hi,

I am a EU Citizen living in UK and my non-EEA spouse is about to apply for EEA family permit from her home country.

the FAQ here states:
Q2: What do I need to submit with the EEA FP application?

If you are married to a EEA national and you travel to the UK together (or to join the EEA national) all that is required:

- Proof of relationship (marriage certificate or birth certificate for children).
- Passports
- A declaration by the EEA national that the non EEA national would be travelling together or joining him (make it simple. One or two lines is enough).
* (If the EEA national has been living in the UK for more than 3 months, then proof of exercising treaty rights i.e. payslips or proof of study etc).

That’s all. There are no other requirements.

If you recently got married, you might want to add a letter or some evidence to show this is a genuine marriage and not one for immigration purposes.
Q4: Do I need to answer all the questions in the application form?

No.

In most cases, there is no need to provide any information about your financials or the non EEA employment. If the EEA national hasn’t been living in the UK, then his employment information is not relevant as well. Your future intentions are also not relevant so questions on your intentions or duration of stay also don’t need to be answered.

If you can’t leave a field empty in the online form, just write “not required for EEA Family Permit”
this sounds too good to be true?

The online form at visa4uk.gov.uk has detailed questions about the applicants finances, employment, accommodation, family, travel record etc..So they can all be ignored?

Also the Guide To Supporting Documentation for EEA FP lists documents such as bank statements payslips, even a letter from employer:
a letter from your employer on company headed paper – detailing your salary and the length of your employment, confirming that you have been given time off work, and stating whether this time off is paid or unpaid
So this is all a smoke screen?

We are in touch with a solicitor who is willing to give guidance for a considerable sum. This otoh is just an internet forum. I don't know whom to believe.

You need to get up to speed and do some of the heavy lifting yourself.

To get started, if you search the forum you will find plenty of members' experiences in relation to FP, some good, some bad, some shocking. Most will prove informative.

could someone give me a hand with this form?

so on https://www.visa4uk.fco.gov.uk I select
Reason for Visit: Other
Visa type: EEA/Swiss daily Member
Visa Sub Type: Family Member of an EEA national
correct, yes?
Travel date
how far into the future? 1 Month? What if it is too soon?
How long do you intend to stay in the UK?
she wants to apply for RC after, so what to put? 6 months, n/a, permanently?

On that note, what happens when the RC application is unsuccessful?
Have you been refused a visa for any country including the UK in the last 10 years?
...
Reason for Refusal (in 30 characters)
OK, so my spouse had been a refused a schengen visa once because she had not enough ties to her country of residence (not even a job) and a family member of hers is staying illegally in said country. How to spell this in 30 characters?!
Please enter details of what you plan to do whilst in the UK
live with my spouse and look for work as a xyz?!?
Do you have any friends or family in the UK?
are uncle's, aunts and cousins relevant here?
What is your current working status?
she is employed full time, but how the hell is this relevant?!
How much do you spend each month on living costs?
How much of your total monthly income is given to your family members and other dependants?
What is the cost to you personally of your trip in GBP(£)?
The total amount of money you have for this trip
The cost of the aeroplane, boat or train tickets
the cost of your accommodation
what is it to them? What is the purpose of all these financial questions?!
Is someone other than you paying for all or a part of your trip?
should I just say that I am paying for it? Or is it better if she can pay it herself?
Are you being sponsored by a person(s)?
yes/no? My details are entered 4 times already in this form as EEA National, husband, residence etc

Suggest print out the paper version and practice on that first.

They're asking the questions, all you need to do is respond. And keep a record of your answers (Again paper form handy here).
not enough ties to homecountry
= 30 characters

If a subsequent RC is refused and you're married to a qualified person then apply again (with better evidence).
If an unmarried partner and refused a RC then you will have no basis to remain in UK.

YES

I put the date as 3 weeks from the appointment date

Tell them the truth. I personally put "2 years". In your case, just write "indefinitely"
On that note, what happens when the RC application is unsuccessful?
Have you been refused a visa for any country including the UK in the last 10 years?

"not enough ties to home country"

Yep, again, just be honest! "I plan to live with my spouse and find work in my field of choice"
Do you have any friends or family in the UK?
are uncle's, aunts and cousins relevant here?
Haha i was confused by this too, I have plenty of friends and colleagues in the UK! I ended up putting down 2 girl friends :)
What is your current working status?
she is employed full time, but how the hell is this relevant?!
I guess it's not relevant but answer it honestly "FULL-TIME EMPLOYED"
How much do you spend each month on living costs?
How much of your total monthly income is given to your family members and other dependants?
What is the cost to you personally of your trip in GBP(£)?
The total amount of money you have for this trip
The cost of the aeroplane, boat or train tickets
the cost of your accommodation
what is it to them? What is the purpose of all these financial questions?!
Who knows what they do with the info. Just answer each question as it comes.
Is someone other than you paying for all or a part of your trip?
should I just say that I am paying for it? Or is it better if she can pay it herself?
For this part I wrote that both my partner and I were funding the trip, as the visa application is a common interest/ground for us both.
Are you being sponsored by a person(s)?
yes/no? My details are entered 4 times already in this form as EEA National, husband, residence etc
YES, you are being sponsored by a person. It is really frustrating that you have to fill out the EEA national's details 4 or 5 times on the form, it's quite silly, but just fill out as you go :)

Hope it all went well :)
