Apply on MN1 or wait for 10yrs Route?

Dear members of this great forum.
I have an 8-yr old UK-born son who resides with his non-british mum with no valid Leave to Remain. Actually we have 2kids together; one still overseas- but not uk-born. Presently I have ILR and planning to register him.
Kindly help to determine the better route, taking costs of applications into consideration: should I apply through MN1(3) now or wait till the boy turns 10yrs(when he'll automatically qualify on his own merit) in about 14months' time?

MN1 is cheaper @ £936.
Form T (10 years route) is £1,121

Your choice, but as he is eligible for MN1, you can do it now, he will be British otherwise than descent.

Many thanks CR001 for advising way forward.
Another concern is the fact that my son resides with the mum, should I worry about this if I state it on the application?

Are you named on the child's birth certificate?

Are you and mother 'partners' or separated?

Only one parent requires ILR to register under section 1(3). Mother will have to sign consent on the form too.

Yes my name appears on the birth certificate as the father. We planned to marry but it never happened, though we lived together for some time which ended in 2008. She has another child for another man now, I am not sure whether she's married to her new man.

If your child was born after a certain date, HO would expect DNA proof that it is your child if you were not married to the mother.

Will have to look for the link when I get home from work.

Thanks Casa, I found the information very helpful. I found from the link that the cut-off date is 10 September 2015, thank God it would not affect me.

In both cases there is or will be an entitlement to register, so I would say go for MN1 now before he reaches the age of 10 and has to meet the good character requirement. That way, he can still become British even if he starts stealing cars.

Children going off the rails is a risk all we parents face. It's one of the risky things about the Form T route - the good character requirement always applies. Other registration routes may allow a child to be registered before it becomes subject to the good character requirement at the age of 10.
