I re applied for my wife's spouse visa second time in April and just received a refusa second time. This time they refused only on financial grounds as it mention I didn't submit payslips from my employer even though I did submit P60 and a letter from employer along with sa302 form for last two years stating my income as 21k and 18796 respectively. On self employment they wrote the same line as my earning only based on information provided in sa302 which does not independently corroborated has actually earned that income however I did also submitted all evidence of invoices and my bank statements from my self employment.

Now I would like to ask which option will be better and quicker either to appeal or re apply third time with priority service and what will be the chances of getting successful visa.

Thank you
Did you applied under self employment? sole trader or limited company? or it was self employment + employment

This was my second application as I was employed n self employed during my first application. In second application employment was terminated on March 2016 as it was already in refusal of my first application so I submitted P60 n letter from emplyer. Furthermore I'm also a self employed sole trader for past few years and it is my main earning so I submitted invoices, bank statements and sa302 for last two years. Also submitted my UTR letter from HMrC.

Hope it may give you guys clear picture.

I see a couple of issues here, if you ticked the self employment box, then depending on which category you further ticked (F or G) you needed to provide all the evidence.

For self employment all of the evidence on page 60 of this link should have been provided

https://www.gov.uk/government/uploads/s ... rement.pdf
Applied: 14/11/2015
Refused: 02/03/2015
Appealed: 28/03/2015

Thanks kimak for your help. I have submitted all those required on page 60. But they refused by saying this income just based in sa302 form presented which independently does not corroborate. Would u kindly please suggest me to either go for appeal or fresh application? Which will be quicker n successful

You can do the new application, it will be quick and with priority even quicker.
BUT my advise is to make sure that you address, whatever there concerns were clearly and with evidence.
Remember, the burden is on the applicant, and the standard of proof is the balance of probabilities.

I would suggest you prepare a letter detailing how you meet the requirements as self employed, why were you refused earlier, and how are you addressing the reason for the previous refusal, such that one could read and beleive you along with the latest evidence to support the fresh application.

Appealing is a long process, and it is extremely frustrating to wait (for an unknown period of time) to actually start a life with your partner. If you appeal, and if it goes through the court then you're looking at around 1.5 years, and if the decision is overturned then that is 8 months roughly.

So doing a new application is the best approach, i would also suggest that you write down a list of documents and post them in this forum so that other users and experienced members can take a second look to confirm.

You can also appeal and put in a new application at the same time.
Applied: 14/11/2015
Refused: 02/03/2015
Appealed: 28/03/2015
Payment Taken: 20/04/2015
Appeal Notice: 15/06/2016

Annonymous wrote:Aoa to Everyone,

By the Grace of Almighty Allah My lawyer has finally received today a written decision from the Courts. Sad thing which I have understood after reading the letter is that I have to wait for another 28 days before the BHC Islamabad will give a call letter or before my wife will receive any kind of email from them but anyways Allah Ka Karam Hay for receiving this. I have waited 4 years for that so another 28 days wont be much of a difference to me.

I just wanted to get some kind of input from the respected members that when will I be able to find out that what exactly my wife has to submit when submitting her passport will I get notified by the Home Office to submit a New TB certificate or God Forbid another IELTS as well ? How long more will it take once the 28 days period is lapsed to get a call letter or an email as I know very well that how good BHC Islamabad performance is which is just commendable.

Waiting for your useful replies.

Please remember me in your prayers and I'll also remember everyone in my every single prayers.

Kindly keep us updated on the forum with the outcome of your spouse visa applications/appeals.

Good luck to everyone.
Congratulations on your successful appeal, your wife will have to submit a valid TB certificate with her passport, I suggest getting that done while awaiting call letter, she should receive email call letter in a few weeks inshallah, once she receives this she needs to make 2 copies and take them with her, if your application was made after the introduction of the IHS fees, that will also have to be paid before visa is issued.

Hello, there is no need to make an appointment, you need to await for call letter email, once that is received you need to make your way to the VAC to submit passport, a valid TB certificate is also required.

That's correct, 2 copies of the call letter are required, also photographs, I recommend getting the photos done at the VAC as they never seem to accept the ones taken from elsewhere
