Dependant Continous Period Calculation

Post by anoops1984 » Sun Jul 31, 2016 8:17 pm

Hi All,

I got my ILR approved at Croydon PEO on 29th July 2016. Now I need to apply for my dependents, but I am having issues interpreting continuous period calculation for dependents. They have lived in UK more than 2 year but not in one stretch.

Category: Tier 2
Dependent visa start date: 27/05/2012
First entry: 09/07/2012

Out of UK:
13/03/2013 - 10/11/2013 - 243 days
03/09/2014 - 06/05/2015 - 307 days
26/05/2016 - 11/06/2016 - 15 days

The above list apply for my daughter also. Total time spent in UK as dependent till today is 919 days (30 months approx). No break in the visa, they applied for extension with the main applicant in UK. The reason for the long holidays is to take care of her ill father as her sister temporarily moved to US for project work.

What is best way to calculate the continuous qualification period?

Is it possible to apply for my daughter using SET(F) form if my wife is not eligible for continuous period reasons?

Please share your thoughts in this case.

Thanks in advance.

As per my previous experience, Generally homeoffice dont care about absences for dependents. But you need to prove cohabitation proof living together for 2 years. i.e. 3 sources spanning 2 years i.e council tax bill, nhs letters, utility bills, electoral letters.

Suresh

Hi Suresh,

Thanks for the response. Is that same case when they apply separately as my wife will be considered as a main applicant in SET(O) form?

Thanks

Hi All,
Just an update, might be useful for others in the similar situation.

My dependent got her ILR application approved at Sheffield PEO today. She had more than 500 days absence in last 4 years.

Thanks

Congratulations...

try to keep dependent little bit more with you :) in the next one year if you want to apply for citizenship as below might apply in citizenship.

"To satisfy the residence requirement you should not have been absent for more than
90 days in the last 12 months. And the total number of days absence for the whole 5
year period should not exceed 450. If you are married to, or in a civil partnership with
a British citizen, the total number of days absence for the whole 3 year period should
not exceed 270."
