EEA Family Permit

If a South African national sought to apply for an EEA Family Permit for the UK through a German National - their spouse - both residing in SA, what would the implications of applying outside of the EU be? In particular, what additional Immigration Rules would need to be satisfied and how would this be achieved/demonstrated?

Might it be easier if they returned to Germany and the non-EU spouse applied for the permit whilst on a visiters visa?

That application can only be made in SA, and the rules are just the same.
