UK spouse visa checklist help

Hi forum members

I am in the process of gathering documents for my wife's settlement visa to the U.K.
We had a previous visit visa refusal so I feel the need to add some extra pieces of evidence.
Please let me know if I've put too much/not enough?
I know you cannot check the finer details but an overall opinion would be helpful
we have not yet filled out the appendix 2/online application or Su07 form ( not sure if I need SU07 form?)

Applicant:

What about the Immigration Health Surcharge payment and reference number?

No my passport copy is not yet certified.

I have £9,000 in an ISA account.

Payment schedule letter from HMRC just stating the set up of direct debit/ payment dates and amounts. I do not owe any tax/Ni but I am paying in parts towards what is not due until Jan 31st 2017.

Addendum and house particulars are parts of the documents we have collected going through the processes regarding Thai marriage.

All accommodation documents I will provide are originals

Yes the certifications were translated by registered companies, stamped,addressed,dated and signed

Savings less than £16k will not be counted.

Do you meet the financial requirement of £18,600pa with your earnings/salary?

Suggest add the company registration/companies house documents for your business.

As you are self-employed the qualifying figure for the £18,000 p.a earnings will be after allowable business expenses have been deducted. i.e the nett amount on which HMRC have calculated for tax due.

So I am paying tax on £19,400 ahead of the Jan 2017 deadline.
I am a sole trader
My wife has no dependant children.

Sorry about interjecting, and it may not apply here. But in the category of "forms" I needed to submit these forms/emails/receipts to the appointment centre:

Printed copy of VAF4A
Appendix 2 of VAF4A
Immigration Health Surcharge reference number and IHS payment confirmation
Visa4UK Appointment Confirmation
Visa fee receipt

With regards to cover letters from the applicant and/or sponsor in the UK. I know that normally these are not required. However, they do help to address some important complications in the specific application, and which the "Additional Information" box in the VAF4A does not have room for. Or seems the wrong place to give the information.

In the case of a letter from the sponsor, Appendix 2's Additional Information box really only concerns itself with accommodation and the financial requirement. In my case, I needed to point out (very briefly) some other information I consider as relevant as the sponsor.

So as a matter of judgement, I think it may be useful to include these.

I think in our situation it would be beneficial as explanations for refusal reasons can be stated in a sponsor letter.

My next step will be the online application, appendix 2,health surcharge etc after I've finalised my required documents.

UKVI will have a full record of the visitor visa refusal, there is no need to explain it to them. Visit visa refusal has no effect or bearing on a spouse settlement visa, they are two different visa with different rules.

Appendix 2 question UK visa

Question 1.21 - Have you or your partner previously been married or entered into a civil partnership.

My now wife says she was previously married, no documents/certificates but where she is from in Thailand many couples make this commitment but without documentation!
In my eyes making it not a recognised marriage?
Even a civil partnership you would sign something?

They asked her this on a previous visit visa refusal via a phone call and she said yes she was married before. So what answer should we give? Would they have recorded this info,? There cannot be a divorce as there was no proper marriage

The HO will have the previous visa application on record and will expect to see a divorce certificate. If the marriage wasn't official with no legal record, your wife should have stated 'No' when applying as a visitor and this may be difficult to resolve now. Hopefully a member with direct experience may be able to advise.
