Switch from Tier 2 ICT dependant to Tier 2 General

Hello all,

I have a query on switching from Tier 2 ICT dependant to Tier 2 General.
I understand if the company is wiling to provide sponsorship, the candidate needs to apply from home country. My question is whether the candidate is allowed to work for this company during the application period from the home country, as the role / work is critical. Also, on an average how long does it take to receive the visa. many thanks.

I don't think this should be an issue as you are on a Tier 2 dependent and free to work with any employer.
Is your current employer sponsoring your Tier 2 General visa?
If yes, have you been pre-selected for this role?

Yes, i am in HR function and within payroll department. If my company decides to sponsor , there is no one to fill in for me while i am in my home country and hence I had the query. DO you think I can still apply for visa while working from home country in this case?

For Tier 2 General sponsorship, your employer will need to fulfill an RLMT to prove to the UKVI that there is no UK citizen/permanent resident who is capable of filling this role.
If you are already on this role, it makes it even more tricky for your employer to prove that you were not pre-selected for the same role.
