Hello.
Me (EEA) and my wife (Thai), have been living in UK for 5 years. We just started process of divorce now (no kids,both parties agreeing). Is it still possible to apply EEA(PR) during after we applied for divorce, but before its finalised? There was no Decree Nisi application yet. She technically is still my wife after all. I know we messed up timing due to misinformation and should had apply for PRC before divorce but its too late now. I also know she could apply for PRC after Decree absolute with same EEA(PR) application, but those new divorce units are incredibly slow and it could take really long time.
Thanks for any answers.

I have been a silent reader to this forum for a while and I thought is about time that I give my timeline since I got a call today from my socilitor who has confirmed that I've got my PR!!! :))

I am a non-EEA and have being with my EEA (unmarried) partner since 01/08/2009.
She did not apply for PR (Only me).

Docs sent: 09/02/2016
Docs received: 12/02/2016
Payment taken: 17/02/2016
Confirmation email: N/A
Biometric letter received: 03/03/2016 (dated: 01/03/2016)
Biometric Submitted: 17/03/2016
COA received: 24/03/2016 (dated 21/03/2016) - Right to work.
Passports / Documents Returned: 15/08/2016
DCPR dated: Unknown for now (my solicitor has received all the docs and I will get them back Friday the 19/08/2016).
DCPR received: 15/08/2016

Total time:
189 days or
6 months and 7 days


I have to mention that I did call last week my socilitor when we had reached the 6 months period time for the HO to process my application (the 09/08/2016 was 6 months exaclty for me). She did sent them a letter on the 10/08/2016 and I got a call today from her confirming I have DCPR. I will be picking up all the docs and passports at the end of the week.

She told me the blue card hasn't arrived yet but according to her she should get it by the end of the week.

For those of you reading this and still waiting my advice is this: do not lose hope! My solicitor has told me that the HO has a huge back log (Brexit aftermath...) and no staff increase on the way (she has inside people at the HO keeping her "quietly" informed...).

Anyway I got it! This part of the road is over for. My life is not anymore on "hold".
Now getting AN Form application on the way as I can apply for British citizenship straight away!

I have sent anything I had to the HO.
Anything between from the date my relationship started up to the date I applied

So it means:
from 01/08/2009 to 09/02/2016 or
6 years, 5 months, 8 days

Any documents during that period of time has been sent to the HO.
Docs sent:

- Payslips
Every months from my sponsor and me (not one missing)
- Employement contracts
from my sponsor and me
- P60, P45s
from my sponsor and me
- Bank statements
her bank account, my bank account + our joint bank account (all pages not one missing)
- Council Tax
- Tenancy Agreements
- Bills
Electricty, water, phone, mobile phones

I don't think this will matter one bit as I never saw them request this in any of their forms, think those who have submitted one has done it on their own accord.

Incorrect, neither the EEA PR or the EEA QP form requests you to send in a pre paid special delivery. Yes the guidance note advises you to do it if that is how you wish to receive them back but no this will have absolutely zero effect on the decision. Here is the exact wording on the guidance notes;
"We will return your documents by Royal Mail Signed For™ Second Class mail. If you would like
them to be returned by Special Delivery, you must provide a prepaid Special Delivery envelope
which is large enough and covers the cost of postage."

So there it is clear it will not make a difference to your applications, they will also return your documents no matter what, the only difference is how you will get your documents returned.

Another update on my application for a BRP (non European):

Application sent (special delivery): 4.7.16
HO received & signed: 5.7.16
Application fee taken: 9.7.16
Confirmation email received: not received
Biometric letter received (dated 4th Aug): 8.8.16
COA Letter: Certificate of Application received 17.8.16 (dated 14.8.16)
BRP Card received: tbc

Thankfully the letter states "You are permitted to accept offers of employment in the United Kingdom, or to continue employment in the United Kingdom, whilst your application is under consideration and until either you are issued with residence documentation or...."

Must admit the CoA came through a lot sooner than I was expecting so perhaps the backlog is thinning - lets hope so for the rest of the forum people.

This is very good forum

I have 5 year resident permit which finish in march 2020. eea married to French nationa. daughter is French as well. we live in london

My wife has been in employment from 2012-2015, After I got my resident card in March 2015, her company shut down, so she has been without job sinch June 2015 until now.. SHE has not been looking for a job

My question is when I apply for a permant residence card in March 2020, will this affect my application,, I am hoping to get her part time job by September 2016 in my cousin company..

plz do reply..

That RC is not a 'visa'. It takes more than living in UK to acquire PR.

On what basis do you think you can acquire PR in 2020?

If wife is your sponsor and yet is not currently exercising treaty rights in any way then you (all) have no basis to be in UK. And PR clock is stopped (for both of you).
So you won't acquire PR in 2020.

Or do you mean you are also an EEA national and also exercising treaty rights in some way?

I just tracked my prepaid envelope and it's on its way ... woohoo! Fingers crossed it's positive ... wouldn't want to do a new application (but will do if necessary).

I haven't received my documents yet ... well, apart from my passport which I requested back some time in June. In fact, I don't even know what they are sending in my prepaid envelope because it was meant to be for my passport and so it was prepaid only for a low weight.
