Confused on how many years I can extend Tier 2 now

Post by rohan2016 » Tue Aug 30, 2016 12:58 pm

Hi,
Brief info:

First TIER 2 VISA
Issue Date: 13 May 2013
Expiry Date: 15 June 2015

In October 2013, I was sent to another company (B) by my previous company (A) and they told be they will be still paying for me for another 3 months.

Then, in December 2013 – ceased employment ( company A)

But, I continued working there (company B) with no payment and without being sponsored.

Then, in March 2014,I received Curtailment letter saying either I should make a fresh application or leave the country.

Then my company created COS and I made fresh application and I got my TIER 2 VISA.
Also please note that my current COS states
Tier 2 (General - Changes of Employment)

Second Tier 2 VISA

Issue Date: 8 July 2014
Expiry Date: 30 June 2017

My question:
1. I will be extending in April. So how many year/years can I extend?
2. Will I be Eligible for ILR (keeping £35,000 pay threshold aside for now )?

Also these are the holidays I have taken so far. I am again taking off for 1 months this December also.
December 2014 – 21 Days
2015 – May, June – 30 Days
December 2015/ January 2016 – 40 days
2016 May, July – 45 Days

I have read that one shouldn't be away from country for more than 180 days. How does that work?

Best regards
Rohan

1. You should be able to extend till may 2019 considering your initial leave was granted in May 2013 ( added 6 years to it) 2. You will have to meet all ILR eligibility conditions so if you question is about whether you will qualify based on continuous residence, the answer is Yes.

The rule is you should not be out of the country for more than 180 days in any year preceding your ILR eligibility date. By the looks of the details provided, you look ok.
