Switch from Tier 2 ICT dependant to tier 2 General

Post by goyaldip » Thu Sep 01, 2016 8:31 pm

I am here in UK on Tier 2 ICT dependant Visa and working in one company for last 6 months and my company is ready to sponsor me but they are not aware about the process. I have read multiple post and understand the process but have few doubts . Can anyone please answers these questions -

1. COS needs to be restricted or unrestricted ? Please consider that I am working as permanent employee in the company not the new hiring.

2. Do I need to return to India or I can switch to tier 2 general within the UK?

Please help !!

1. Restricted.

2. You need to go back to India and apply from there.

Point to note - Your company has to conduct a thorough RLMT for the role and prove to home office that they could not find a suitable candidate in UK / EU before hiring you. Since you are already part of the company, there will also be doubts that you are a pre-selected candidate. There are many cases in this forum where the application has got rejected since RLMT was not conducted properly. Your company has to take extra care in RLMT.

If your company is not aware of the process, are they already approved sponsors to be able to sponsor a tier 2 General Visa?

Thank you very much,

Can you please provide some guidance for RLMT, I have seen some rejection based on mismatch salary , incorrect hours and low points.
Also can someone tell me parameters for calculating points ?
I read that
1. RLMT - 30
2. Some points for salary Bracket

Is there any other parameter ?
Is there any minimum value required ?

Yes company has sponsorship licence but they are not up to date with the restricted cos process.

Suggest they get up to speed and read the sonorous guidance then.

Also I am reading guidance document which says -

23.12 When considering how many CoS you may need for Tier 2 (General), you can only
have an annual allocation for the following, which we call ‘unrestricted’ CoS:
 any migrants already working for you under Tier 2 (General) or via a Work Permit,
who will need to extend their stay in the UK to continue working for you
 high earners – any migrants you may recruit with an annual salary of £155,300 or
more
 any migrants you may recruit who are already in the UK under another immigration
category and who are allowed to switch into Tier 2 (General)

As an ICT dependent, you are not allowed to "switch" into Tier 2 General from UK. You have to go back to your home country and apply for entry clearance.
