EEA PR application, including 1 non-EEA family member

Post by vlud23 » Mon Oct 03, 2016 10:34 am

Dear all,
I have a basic question but, unfortunately, I can't find the answer for it.
I hope there are some people here who can assist me.

I am EEA national applying for a PR.
I would also like to include my wife in this application (she is non-EEA national, who's lived in the UK with me for more than five years and has a residence card of a Family remember of EEA national).
What supporting documents do I need to provide for her:
1. Just our marriage certificate (because she does not need to execute "treaty rights" if her EEA husband does?)
2. The marriage certificate and evidence that she's lived in the UK with me for a period of 5 years.
3. The marriage certificate and evidence that she's lived in the UK with me for a period of 5 years and documents showing that she has been "executing treaty rights" (the same as I did) for a period of five years.

Thanks for your replies in help in advance.

Thanks noajthan for this link. It was a very useful document to read through.

The way I understood it from the document, I need to provide evidence:
1. An EEA national has been executing "treaty right" for a period of five years
2. A marriage certificate between the EEA national and non-EEA national
3. Proof that the EEA national and non-EEA national have lived (together) in the UK for a period of five years
4. I (the EEA national) had enough funds to support us both over any period of time when it was necessary to do so.

Am I right saying that the non-EEA national does not have to "execute the treaty rights", if her EEA national does?

I would really appreciate if someone could confirm this on the basis of their knowledge or experience. :)

Yes, that's a good understanding.
Yes, the dependent's activity in UK is immaterial.

Does that apply to EFM too?

Yes, dependent's position in UK is wholly dependent on their sponsor.

Depends on your sponsor's status.
What might that be?
