Administrative Review or Fresh Application

Post by Cino1986 » Wed Oct 05, 2016 4:07 pm

Hello,

I am a University lecturer in the UK. My wife made an application for Tier 2 dependent to join me. Unfortunately the latter has been refused for the following reason:

"As evidence of your relationship you have provided a marriage certificate dated 28/08/2016. However, you have not provided any evidence of any contact you have had or any photographs of any time you have spent together. therefore I am not satisfied that the marriage in ongoing"

I would think that the marriage certificate is indeed a proof of contact, since I cannot do this from a distance. Based this, I am inclined to claim an Administrative Review, do you think it is a strong enough justification? or shall I make a fresh application?

Many Thanks for your help

No, just a marriage cert if not sufficient.

She should have submitted evidence of the relationship

Evidence of communication - whatsapp, skype screenshots
Any visits you have made to your now wife prior to the wedding
Wedding photos
Other photos of the two of you

Thank you very much for the reply. So would you recommend a fresh application?

Probably will be quicker as HO have not made an administrative error.

Evidence for ongoing relationship

Post by Cino1986 » Sat Oct 08, 2016 1:50 am

Hello all

My wife is applying for a dependent tier 2 visa . We only got married late August 2016 . We didn't do a wedding yet , we plan to do it in December. However, to speed up the process we did a civil marriage (without celebration) just to be able to get the marriage certificate , so in short, we are officially married but haven't celebrated yet. To prove our relationship we are providing the following

Marriage certificate
Photos of times we spent together (mainly having lunches together)
Photos of civil marriage ceremony (basically photos of us, parents and witnesses signing the marriage registrar)
Skype calls and records (since January 2016)
Records of emails
Letter from my uk landlords confirming that my wife will be joining me
Copy of hotel booking in London for honeymoon

Are these enough? I am a bit worried that I am not able to provide wedding photos since the latter hasn't taken place yet

Please help
Thanks
