Tier 1 (General) ILR Route, Continuous 5 Years Period for ILR

Post by Kumar101 » Thu Oct 06, 2016 10:57 pm

Dear Moderators,

Really looking forward to your guidance my situation.

I am planning to apply for ILR, but not sure if I am already eligible for it (or should I wait for another 180 Days)

Tier 1 (General) Visa valid from 20 Jan 2011, but entered country (only for a week) in June 2011. I assume this triggered the Visa as active (if that is a thing).

I finally moved to UK much later on 1-April-2012. Can I apply for ILR now with the following calculations:

Year 1: 20-Oct-2015 to 20-Oct-2016 (0 Days absence)
Year 2: 20-Oct-2014 to 20-Oct-2015 (0 Days absence)
Year 3: 20-Oct-2013 to 20-Oct-2014 (0 Days absence)
Year 4: 20-Oct-2012 to 20-Oct-2013 (0 Days absence)
Year 5: 20-Oct-2011 to 20-Oct-2012 (178 Days absence)

Clearly the question mark is on on Year 5, as I got my job and started living continuously only after 1-April-2012. Can I use my days before this continuous living as by absence days?

Or should I wait for April2017 to 100% complete 5 years and then apply for ILR?

Any help on this will be highly appreciated.

regards
Kumar

Please refrain from posting your identical question all over the forum and from digging up old threads. One topic is sufficient and when someone is willing to provide advice I am sure they will.
