Question concerning 1.35 on Form AN

Post by deewee » Fri Oct 07, 2016 11:06 am

Hi,

a quick question on Form AN. Our situation:
- I acquired British citizenship in February 2015 (originally from Germany)
- My wife is Latvian, has now (as of a week ago) the residency permit sorted (it's in a incorrect spelling of her name - but that's another story!), "life in the uk" test sorted, language test sorted...
- We got married in November 2014 here in the UK

My question now: am I eligible to sponsor her as husband, so she does not have to wait another year?

Cheers
Dan

If she has PR, 3 years residence and meets all the standard requirements, she can apply now as spouse of BC. There is no 'sponsor' in BC applications. It is a concession for spouse of BC that they don't have to wait 1 year on PR.

Brilliant - thanks!

So the fact that I am only BC for 1.5 years and we got married prior to me becoming BC does not matter?

Thanks for your help!

No, it makes no difference. She does not have to be married to a BC for 3 years, she only needs to be married to a BC at the time of application.
