Hi Quiqui, I will be in a similar situation a few months later than you. I am Spanish and my husband is a US citizen. The Home Office advises he obtains a "EEA Family Permit" from the British Embassy in Madrid, which is free and should only take a few days to obtain while they dont achieve a decision. That EEA Family permit is valid for 6 months although its a bit of a hassle.
If your husbands comes from a country that doesn't need visa to come as a tourist, he could potentially just try to enter as a tourist but that would imply lying to an immigration officer and is NOT recommended.
Finally, the EEA family permit isn't strictly necessary under EU law. If you satisfy the immigration official that you are a family, they should let you in regardless, but of course there is a risk.
Also you need to take into account that you need to satisfy the airline that he will accepted. I think that is harder: if the airline let's him fly, I am pretty sure he'll be ok once in the UK but often they are really strict.

My husband and I have just applied for the EEA(PR). I am from Spain and he is from a Non-EEA country. He has a residence card that is going to expire in December 2016. From I can gather here, this application takes up to 6 months to be approved, I am wondering if we have to reapply for an extension of his residence card in case we don't get the permanent residence card before December?
This is our timeline:
Application sent: 30/09/2016
Received by the HO (according the Royal Mail): 03/10/16
Payment taken: Postal Order
Confirmation email: ?
DCPR dated: ?
DCPR received: ?
I hope you can help.
Thanks
you have mentioned that both of you have just applied, however from your timeline I understand that it was only you!! am I correct?
Because you are married to each others! Both of you should have applied at the same time as you may have already passed your 5th wedding anniversary by now! I assume he had his RC few months after the wedding, and you should count from your wedding day rather than the date when the RC was issued (Dec 2011) No need to reapply for an extension, it's just waste of time waiting I think..he better off apply for his PR! but in your case, all the documents have already been sent! I guess the Moderator can gives you better option, but first you need to clarify if it was just you or both of you have applied for PR?

Hi,
Yes, we both applied for the PR (we used the same application) I applied as the main applicant and I added him as a family member.
My question regarding his residence permit is because we are going on holiday in December and we will come back to the UK in January (just after his residence expires) I'm kind of concerned that he is going to be stopped at the immigration point if we don't have the PR by that time. I hope that makes sense.
Thanks for your help.
