Dear all,

A child was born in Brazil in 2001, who is now 15 years old. Father registered her as his child on the birth certificate. Father is Brazilian. Father and Mother never married.Father came to UK , and got married to an Italian national in 2010, and as he is married for 6 years , he has permanent residence in the UK . All this time he was working. I dont know if he applied to be British.

Now the child who is 15 years old, wants to come to UK, but the father doesnt want to help her, because of jeously of his new wife.

1)What is her(child) rights under EEU Law, and in the UK?
2) Can she legally come to UK to live here?
3) How can we know if the father has applied for British Citizenship or PR?

If the father doesn't want to be responsible for the child, I can't see any route into EU. Child can't live alone at 15...

She will turn 16 on January,

So, I do think she can come to UK.

You could ask him.

Unless he has his nationality listed somewhere public, for example on Companies House if he is a director, or perhaps the electoral roll if he is registered to vote, it will probably be difficult for you to find out.

1) No EEA rights; why would there be.

2) Maybe.

Come with whom?
Where is mom?
Mom's immigration status?
Who has custody/responsibility for child?

Unless Dad has cut all ties this will be hard to achieve.

3) If no relations with Dad then no real right to find out, apart from what may be in public record.

An estranged father who may or may not be British now can not help a foreign-born child gain any sort of status in UK.

The only benefit fom an estranged father is it gives child slightly better cgance of gaining a visa via mother. If joint parenting but separated/without sole custody then there's no realistic chance.
