do thé eu citizen

Post by asusblack1 » Sun Oct 09, 2016 8:55 am

Hello again.

I am on resident permit until March 2020
I got my permit in march 2015; in April 2015 my wife company as shut down.. no job. She has been out of employment since April 2015 to August 2016...
She find now another job earning £ 1000 A MONTH.

my question is .. do the eu citizen need to work 5 year continously before I apply for permant residency.

Also my wife was working full time from 2012 April to 2014 June full time and from 2014 august to 2015 April part time..

My wife and my daughter are french citizen. I am Pakistani national.

My daughter was born in October 2014

Please guide me on my wife employment gap about 14 months

Also..

Where do I stand after complete brexit...

Thanks

Your wife needs to have 5 years of continuously exercising treaty rights. This doesn't necessarily have to be as a worker.

What was your wife doing between April 2015 and August 2016? Was she a self sufficient person with comprehensive sickness insurance (CSI)? If not, then she (and therefore you) technically had no basis to remain in the UK. Her (and your) PR clock would have only started in August 2016, so you almost certainly won't have time to acquire PR now.

Nobody knows what will happen after Brexit. The government are keeping tight-lipped about it, and to be honest I don't believe they even have a plan yet.

When say you have a residence permit until 2020, do you mean you have a "residence card as a family member of an EEA national" ? This isn't a visa. The expiry date is simply for the card, at which point it is just renewed by applying for a new one.

I have 5 year resident permit.
My wife did not have any comerhinsive insurance.. however she worked voluntary, temporary in my cousin shop.. She also helped my brother with my brother business. Like making invoices.. but on temporary basis.
I can have accountant or letter from my brother, my cousin company.

I am very worried for this about 15 months gap..

May be I have been stupid, my permit is still valid until 2020. March.

Plz guide me

Voluntary work is not considered to be work (in the context of free movement).
A volunteer can be treated as a selfsufficient person if they had CSI in place.

Looks like PR clock stopped in 2015.

How long have you been in UK sponsored by your spouse/sponsor? (as the issue date of an RC is not a significant factor).

No one can tell you what the situation will be for those without PR after Brexit (in two years or so).
