Related PR !!

Post by malik89 » Thu Oct 13, 2016 1:46 am

Dear all respectable gurus,

I have a question regarding to my (non eea family member of an eeea)and my wife EU national about PR.
We got married in 2012 March and I got my Rc in September 2012 my wife was self employed for a period of (2012 jan to 2014march) and then she was in part time employment working 16 hrs and later from last 1 year from 2014 she is working as a full time employed for 48hrs.
Some how we didn't done the tax returns for both years when she was self employed but now we got in touch with an accountant and he is doing her tax returns with penalty.
Because we got the later from HMRC saying that we have to pay penalty for late filling tax returns.

After all this situation once the accoutant will finish with her tax returns will she be able to send PR card application together with non eea family member of an EEA national which is me to the home office together?
Or its better if she apply for PR individually and later I will apply for PR ONCE she will get the Pr ?
What chances we will have to get our PR ?
CAN any on one please help us with this mater please thanks
What chances we have got to get PR SUCCESSFULLY PLEASE.

Paying tax is nothing to do with acquiring PR.

Work has to be genuine and effective. That's EU law,
On top of that HO applies its PET/MET test to see if it agrees an applicant qualifies as a worker.

if you pass all that then PR may be confirmed (assuming you have acquired PR in the first place).

Noone can say what your chances are - it doesn't work like that and you haven't provided enough detail.
You certainly need rock-solid evidence to back your case and lack of tax registration/tax records does not help your case.

As soon as you have organised your timeline and application (plus evidence) then apply.
You haven't got time to mess about and hang around with the Brexit exit coming closer.

Thanks alot for your answer nothjan.

My time line for this case will be on the page soon and I will not apply for PR card until I will not have a solid evidence.

But my wife was working all the time from last 6 years it's just something we have missed it on time but it will be sorted out soon I know the tax returns we are filling just now and some amendments.

My wife was self employed officially from 2010 July and she has all CLASS NI 2 PAID OF .
plus now she is employed from last 3 years since 2014 jan I think and in 2106 jan she will be 3 years employed and she has all pay slips plus p60 for last 2 years and this year p60 she will get it by april I think.
We are living together from last 6 years and I have every single dacoments Contracts bills council tax etc.
I don't know what do we need more to make it our case more solid ?
but hopefully soon I will gather all the papers and will be in touch once again meanwhile I will be regular checking the forum about other cases .
After all this post if you reply me once again I will be very thankful to you .
