Family with a baby Born in the UK

Family with a baby Born in the UK

I am writing this on behalf of some friends.

they arrived may 2003 to the UK on a 6 months Visa, they never went back to Algeria.
they have a baby girl who was born july 2004, in may 2008 they would have been 5 years in the UK.

is there anything they can do to settle their situation?

Go home and apply for valid LTR, which can only realistically be a skills based one or student.

There might be a route via the concession for a seven yo child in 2011 but by then in the ever tightening web that option may be closed. Indeed the entire family may have been deported by then.

Hoping to get valid LTR by dint of having a child born in UK? Not really possible - since neither parent had vaild LTR

If they don't have HSMP or a work permit, then the five years' residence in the UK doesn't mean anything, as they don't qualify for anything.

Wanderer's option of the child concession is their only option., but that might take a long time as it is outside the immigration rules. If they want to do something immediately, they would have to return home and apply for entry clearance.

Did they ever apply for asylum?

nope never applied for an asylum
