I am working for an India company deputed (L1 visa - Intra company transfer) to USA and has been staying in this country from past 3 years. We will be given a living allowance in US (around 45k) and Indian salary is also paid in US as global salary. Tax is deducted here in US for both. The Indian salary converted to dollars is directly credited to my checking account but living allowance is credited to a third party payroll management company and from there I transfer to my checking account. Here is the complication.
1. I have payslips for past 12 months but my company is not going to stamp on them. Instead I can get a letter from them stating my gross income as around $60,000 (living allowance + indian salary converted to US dollars roughly equals 60k). I can trick them saying that I am applying for my parents visa and it will contain "whomsoever it may concern" and it will state my start date with the company and my gross earning in US. Is the letter sufficient?
2. If I cannot show living allowance for HSMP, I have to totally rely on my indian earnings , which by the way, fetches me more points than gross US salary but the problem is that I have not paid tax in India in past 3 years as my tax is deducted in US for global salary. Hence no tax returns and even in payslip there is no tax deductions.
3. In my bank statements, there will be an entry for a direct deposit from my company but for the amount around 1000$ and for the transfer I do from that third party payroll management company, the entry in my bank account does not contain my company ID. It will look like any regular deposit.
