Dear Forum Members

They have refused my application mentioning the following caluses
Clause 135A(i)
The applicany must produce a valid document issued by the home office confirming that he meets, at the time of the issue of that document, the criteria specified by the secretary of teh state for entry to United kingdom Under Highly Skilled migrant programme
for this clause 135A(i) I have attaced the Origunal HSMP aproval letter and they have returned it back.
Clause 135HA(11)
The immigration Officer for the Secretary of State has cause to doubt the genuineness of any dcument submitted by the applicant and having taken resonable steps to verify the document, has been unable to verify that it is genuine.
Additionally your application falls to be refused under paragraph 320 of HC 395 specifically
(15) whether or not to the holders knowledge , the making of false represenrtaions or failure to disclose any material fact for the purpose of obtaing an immigration employment document
(21)Whether or not to the applicants knowledge , the submission of a false document in support of an application.

They have kept my salary certificates, wage slips and employement refernce letter from the employer.

Dear Forum Members please help me in lodging the Appeal

Should I file/ send the application to the Embassy in Islamabad or the Aslylum and Immigration Tribunal London. It matters if one applys in the local embassy or the

I have applied EC for myself , souse and daughter, should I appeal for all the three or should I appeal alone . I have to send passports along with the appeal form.

Seniors please help.

Dear Waheed,

first of just be cool, it seems that in BHC in Pakistan enjoys rejecting visas with such reasons. My friend got rejected with reason that his degree is fake which was approved after appealing. So be patient and cool!

you need to send appeal to AIT not local BHC. You should appeal for yourself , your spouse and child (spouse and child as dependents).

Can you please let us know when your HSMP approval letter was issued? as they are saying that it is no more valid.

Dear JD Bro

I got my HSMP approval letter dated July 13, 2007 from Home Office on July 19, 2007. (after a long period of about 1 year) you can see the start of thread for my whole episode.
Can you please let us know when your HSMP approval letter was issued? as they are saying that it is no more valid.
They have not said that it is no more valid its valid till January 12, 2007 six months from July 13 ,2007.

Moderators/Senior Members please help as I am short of time (28-11-2007 last date for appeal)

I talked to one of the leading consultant for appeal he said that u can either appeal or reapply for the EC ( as they have given you the original HSMP letter Back and its still valid till January 13,2008)


Part I

1)If I appeal how long will it take ( 3 to six months am I right about this duration)

2)Can I use the same form AIT-2 received with the Letter of Refusal or I can download and print it from computer as it will not be possible to fax the so long page AIT-2 form in one go as I have to fax the back side also

3)How long wil it take for the documents to reach the appeal office in London as ECO rejected my case on 1-11-2007 and the last date for appealing the decision becomes 28-11-2007/29-11-2007.

4)What If I send all the documents by fax latest by 25-11-2007 and then send them by post also.

5) What strong ground of appeal should I make so that ECM overturns the Decision of the ECO and issues the visa

6) If I win the appeal I have to pay again for the EC ( I have to pay the RS 25000 per applicant fee again)

Part II

1) If I reapply for EC ,I alone have to reapply or we three have to reapply. if I reapply alone ECO officer will reject the application giving reason that u do not intend to make UK your home contry as you are not takinf your spouse and daughter with you

2) The documents I have submitted at the time of previous EC should be submitted again as they have retained my original salary certificate, wage slips, employment reference and bank statement

i am following your posts since long, sorry to hear about your tregedy. some one in group advised you to apeal through a consltant,i also think that you should go through a consltant.

I dont know their reason why thet are saying that the documents are false.

Dear Victoria Please advise me what to do as they have not called my employer and they are saying that they made enquiries with my employer. My refusal Letter date is 01-11-2007

All these documnets I have submitted at the time of Initial HSMP approval they have verified from my employer now they are saying that they are not genuine and refusing my entry clearance under the following clauses 135A (i), 135 HA (ii) and 320 (15) (21) of HC 395. (they are charging me of deception)

Your help Required.

Sir,

I applied for Entry Clearance on 29-10-2007 in the Lahore VAC. The guys told me to keep in touch on numbers 8865 and 090010411 after 4 days. From November 2, 2007 I daily called on the numbers 8865 and 090010411 but the guys told me that the status of my passport is not yet clear and they have not received the passport back. On Friday November 16,2007 I visited the VAC in lahore and the handed over me the Packet . On opening the packet I found the refusal Letter and the AIT-2 form.
Sir,please kindly inform me what I should write in the

Section C Name of British Mission Overseas.

Section D Date of Service

Date of service either November 1,2007(ECO decision date) or November 16,2007 (date on which I received the packet. along with refusal Letter and the appeal form)

Section E Deadline to appeal

Either 28 working days or calendar days from the date of service.

I willl be extremely thankful for the information requested.

Dear Forum Memebers,

This is an awsome forum, provided me a lot of help in filing my EC application. Unfortunately there are few experts on the appeal, so atlast I have faxed a letter to Mr Robert Brinkley British High Commissisoner and Entry Clearance Manager on 28-11-2007 asking for the review of my case, nothing happened, I have also sent my appeal application through IAS (Immigration Advisory Service have made my grounds of appeal ) to the BHC on December 5th,2007.

They told me that if Entry Clerance Manager will reveiw my application in the 28 days they they will overturn the ECO refusal decision or other wise my case will be forwarded to the Appellate Tribunal ( minimum one month to maximum of six months for the appeal process)

Hi Fellows,

Have applied for HSMP EC on 25th Jan 2008 with 2 dependents from Khi VAC. The VAC opens at 8 AM so i was there at 8 AM. We were the 1st ones at the VAC that day!!!

A total of 3 counters were involved. I didnt have to go through to the cash counter because i had bank drafts drawn on HSBC bank (no bank draft charges). The 1st counter did a prelimiary check on my docs. The 2nd counter checked the docs more throughly & gave me a receipt. Strangely, they returned my original birth certificate, my driving license, my daughter's original birth certificate & my original NTN certificate, but took copies of these docs instead. (I hope they know what they are doing). The 3rd counter took bio-metrics & that was it. The whole process took about 1 hr.

Here are the docs I submitted (hope it helps):
1) Passports
2) 1 x photograph per applicant
3) Resume
4) 3 x Bank drafts (Rs. 26000/- for each applicant)
5) Cover letter requesting for a post-dated visa stamp
6) Printouts of job search results form jobserve, cwjobs etc
7) Original HSMP approval letter (copies with dependent applications)
Bank statements for last 16 months
9) Payslips from last 16 months
10) Income Tax Return for period of employment
11) Salary letter from employer
12) All other letters from employer (like promotion, confirmation etc)
13) Certificates for professional certifications & workshops/trainings attended
14) Notarised copies of Defence Saving certificates
15) Notarised copies of gold jewelry receipts
16) Stamped copies of provident fund statement
17) Letter showing self-made financial summary
1 English translations of B-form & NICs
19) IELTS certificate
20) Original post-grad degree & transcript
21) Original bachelors degree & transcript
22) Letter from university of bachelors degree taught in english
23) UK NARIC letter
24) Inivitation letter from friend for accomodation (including notarised copies of his passport, driving licence, mortgage statement, bank statement, gas/telephone bills)
25) TB screening certificate from IOM (for myself & spouse)
26) Original nikah nama along with english translation
27) Marriage ceremony photographs
2 Experience letter from previous employers

My advice is take photocopies of everything being submitted. They might return the original & ask for the photocopy instead.

Called the Gerry's helpline yesterday who said to call after 5 days to check the status.

I tried the website hxxps://www.vfsglobal.org/applicantstatus.aspx but the site keeps saying 'enter a valid ref no.'? Am entering the whole 'GRY-PK-...' no. but without luck. The helpline guy said to check via calling the helpline rather than checking from the website (it might be down).

Are all visa applications dealt by BHC, Isl or are khi applicants dealt by BDHC, Khi?

Does any one know what are the processing times for HSMP ECs these days?

Anyone else in a similar situation?

are you putting the correct reference number? with the DOB.

I have a similar situation, but it gives me the only status the case has forwarded to the british embassy. Which date you have applied. Mine is 4th of February.

I don't know still you remember me or not.

Anyway,

By the Grace of Almighty ALLAH the appeal was made in my favor.
But now I am totally unaware of the new rules and regulations.

I have applied when the requirement points were 65 points.

Now what I have to do?
Do I have to apply for the EC again?
What to do as my HSMP Approval letter is expired?
Pay all the dues Visa Fee again?
Do I have to submit all the documents, experience letters and bank statements again.?
Is there any time frame in which I should apply?
How long will it take?
Will the BHC make all the verifications again.(From Employer and bank)


Any help suggestion will be appreciated.

43 days passed since my appeal allowed. Not received any call letter from BHC.

Please guide me what to do.
