Currently waiting for a court date and its taking for ever.So stressed out about waiting.
I need to know aswell. I appealed today but want to put in a 2nd application aswell. Will putting a 2nd application in cancel my appeal? This appeal is costing me £140 wheras if people get rejected now appeal is £800.

It will cancel your appeal.

I applied for uk spouse visa in October 2015
It got rejected on basis of my wife's income
I appealed the decision in May and given date for appeal was in October

Today I received a letter saying
Notice of home office decision withdrawal
It says the Secretary of State has notified the tribunal that the decision to which this appeal relates has been withdrawn
Under rule 17(2) of the tribunal procedure the tribunal must treat your appeals withdrawn unless there is good reason not to do so
If there is good reason why your appeal should not be treated as withdrawn you must write to the tribunal within the time limit
If you consent to your appeal being with drawn you should also inform the tribunal

Can anyone advice on this please that what does thIs mean

It means your refusal decision has been overturned, get your TB certificate renewed, pay your IHS fees, pack your bags and await for an email to submit your passport.

hello everyone,
I have submitted appeal for spouse visa n review deadline is 25th nov but i rcvd an email frm home office 2 weeks ago that they are satisfied by our proofs on the basis of which they refused the visa
So they emailed again to submit IHS fee.
But they havent email saying the decision has been overturned instead they directly asked for IHS payment
What can i assume from this????? Can anyone help

Salaam all.

Just to let you all know my wife is now with me after one year alhamdulliah.

We submitted a case in October 2015
This was refused January 2016
Appealed January 2016
August 2016 we submitted a new case whilst the appeal was ongoing.
September 2016 the old case was overturned!
October 2016 the new case (priority service) is successful and thus my wife is here.

Good luck to everyone. It's a painful process and it is unfair due to the amount of money the home office is making.

Inshallah those who are waiting still, you will all have good news soon!

Your original refusal decision has been overturned, pay the IHS fee, renew your TB certificate, pack your bags and await email to submit passport for visa stamp. Congratulations.

You have to send in any additional proofs just before the court hearing, include a witness statement in there from the appellant and the sponsor covering the reasons for refusal and why you think the decision was wrong.

Hello

Why is everyone asking if u can leave ur appeal
On and reapply and everyone is saying no unless u withdraw appeal?!?????

The answer is yes u can do both!

I have done it myself and know 4/5 people personally to who have done it

Appeals take tooo long!

If ur deadline has passed and ur case is up for court it can take 6-12 months from deadline just for a court date (court date is normally 4/5 months later) then once u have been to court etc got judges decision etc and IF successful and once u have handed in passport and got it back that all takes another 3/4 months?

The fee has gone up aswell to £800! From £140
Might aswell apply via priorty

Goodluck everyone

Unfortunately it's just a matter of waiting, you should receive an email to submit passport and TB certificate from the VAC where you made your original application in the next few weeks, there is nothing other you can do than wait.

Hi some may remember me from before my visa was refused due to my step dads immigration status well I had my appeal last month and the judge was annoyed to find the home office hadn't sent him all my paperwork lucky I had proof of postage and after my appeal he received them along with the court papers my mum had kept from 2004 regarding my step dads appeal to come to the UK and I WON just waiting for the call letter now also enjoyed my 2 months in Pakistan very hot and now baby news so he will be here for the babies birth too sooo happy.
