Tier2 Licence suspended what are the chances

Hi,
my employer licence is suspended after the UKBA visit, they gave the company 20 days to provide evidance and challenge the suspension before licence revoked.
The points they mention are like they are not happy with job titles and the work employees do which is a low skilled work, and employee tracking system and attendance and system and small difference in wages paid and also he is not happy with evidence of work produced. they even mentioned that these jobs are no there you created them to employ migrated workers.

what are the chances are these kind of suspensions lift off, and what will happen to us the employees.

can some one please help us in this stressful time.

the titles are bit different to the work we do, but wages are right and all are genuinely working here, this is a small company and we don't have any kind of attendance system to track employee attendance and leaves they all happen verbally.

It is almost certain the licence will be revoked based on the information you have quoted.

Reading between the lines the main thrust is the fact the the job titles and associated SOC used to issue the COS and grant the roles are being classed as non genuine vacancies.

All the indicators are there, not able to demonstrate the work in the role, lower skilled activity being undertaken and not being paid the appropriate rate for the job, however small a difference. Small company, likely to have a high percentage of T2 in the work force.

The HR systems are a minor point they can be put right but the non genuine vacancies - that will kill any licence.
