Hi Shshi16,

Please could you let us know what is 'Patel' process?

shshi16 wrote:Then what about Patel process

In essence, the policy provides that, in cases of potential discretionary
refusal under paragraph 322 of the Immigration Rules, caseworkers
should follow the ‘Patel’ process. Where this is not done, the resulting
decision will not be in accordance with the law.”

If the application falls to be refused under 322(2) to 322(12), then as
full consideration of the application is required then caseworkers
should proceed in the way set out below.
The caseworker should first of all check whether or not the application
was submitted prior to the expiry of the applicant’s leave to enter or
remain.

After 7 months waiting for the postal application , I got the following letter

Although we would normally decide your application within six months from the date it was submitted , unfortunately this is not going to be possible in your case.

This is because your application raises exceptionally complex issues and we require further time to consider your case thoroughly and reach a decision

Any idea how long I have to wait from now ??

Indeterminate. Or as the saying goes 'how long is a piece of string'?

You've received a standard reply for a case which can't be decided within the Home Office published guidelines, with no confirmation of how long it will take to process.
