ILR application eligibility date

Hi All,

Apologies if a similar question has been asked before but mine is a peculiar situation. Hence wanted an expert comment.

I came to UK for the first time in Mar 2008 on Tier II ICT and left in Mar 2010 but then came back in June 2012 and moved to Tier II General in May 2015. As per rules, I should be eligible to apply for ILR in June 2017 when I complete 5 years. However, there is a clause that we can be away for 180 days in a year. I had a valid visa in Jan 2012 so if this rule is considered then will I become eligible in Jan 2017? The reasoning is that in the first year, I will be considered away for first 6 months and then continuous stay for 4.5 years from June 2012 to Jan 2017. Please clarify if I am eligible for ILR in Jan 2017 (Dec 2016 if 28 days before 5 yrs completion) or will I be eligible only in June 2017. Thanks

I have already gone through the document and anything else available on the net but haven't found any definite answer for my situation hence asking for an opinion here.
