ILR 5 year time from Tier2

Post by rizwanvu » Tue Dec 06, 2016 11:45 am

Hi
Please help to find date for ILR .
I received my tier 2 visa in end of May 2012 but I start job from 1 st of July 2012 because house shifting and some family issue.
My question is
1: can I count time for ILR from end of May when I received my BRP card or 1st of July ?

My employer issued experience letter from 1st July 2012 that's why I am confuse might be caseworker will conside 5 year from 1st July 2012 not May 2012? Please advoice me what law say in this satiation.

Regards

HI

Can i attached my experience letter ( which starting data after a month ) with my ILR application. any negative impression on caseworker .... actually in UKVI website eligibility of ILR is

''you’ve been living and working in the UK for 5 years ''

according to this line working also required 5 year ? or Tier 2 , 5 year residence only required?

Thanks

My situation is similar to Rizwan and I asked about this in another page but didn't really get a celar answer.
I know the guidance in April 2016 states you can calculate from the date of issue as long as your entry is less than 180 days later.
however there is another guidance which is released in 24th November 2016 and it says in page 4 section 5 (If you entered the UK with a visa several weeks or more after the date from which it was valid for use, you may need to apply for an extension of stay to complete the relevant qualifying period.) I am not sure if the moderators have seen this latest guidance or not as they always seem to be referring to April guidance.? does this later document cancel the April guidance or am I looking at the wrong document? the link to November guidance is:
https://www.gov.uk/government/uploads/s ... _11-16.pdf

would appreciate if someone could read page 4 and advice please as I am terribly confused.
