Looking for best solicitors(ILR)

Post by kathryn2008 » Wed Jan 30, 2008 10:59 am

Hi,

I'm trying to apply ILR by premium service(same day).
I've tried workpermit.com & 1stcontact.com.
Since my case has a small gap in my 5 years (due to
passport hold by HO) they both didn't show much interest
on my case.

Also some other solicitors said yes, but I'm not satisifed
with them. The reason is, they could just try and learn
with my case.

I'm looking for real professional who can argue my case
strongly to HO.

Can any one suggest me real professional solicitor
with good experience on appearing for same day ILR?

Kathyn,

Save your money, tell the board your problem and I'm sure you will get the very best advise from the members on this matter, which has been dealt with on many occasions.

You say you have a small gap in your 5years please explain and lets see what can be done to help.

Thank you for the reply

My previous employer applied
for FLR on FEB 07. But since the Work Permit extension application
was rejected, HO send the passport back to me after 4 months.

My then solicitors advised me to appeal and we did that.
Again the case went against me.

By that time, I've found a new employer and got WP and FLR.

So my FLR ran out on FEB 07, but the HO sent my passport back
on AUG 07.

When the HO sent back my passport, on AUG 07 I've finished
4 yrs 11 months and few days.

My current FLR starts from SEP 07.

This is my case in brief.

Kathryn,
So if I understand it correctly you had no visa to remain in the country between April 07 and Sept 07 so a 5month gap.
You now have FLR from Sept 7 to when?
When did you first enter the UK?

Please answer the following questions:

1. Did you learn of the rejection of the FLR extension when your ppt was sent after the 4 months or in and around Feb 07?

2. Was your appeal still in process whilst you got the second WP and FLR through the new employer.

These two questions can bring to light whether you had section 3C protection or your clock was reset during the first refusal.

1. I received a letter from HO with my ppt only by then I came to know
of my rejection.
2. Infact even before the appeal is made, I got my WP.
The date of my new employers WP application is four days before
the ppt return date. And the WP arrived after 10 days.

Kathryn,

Had you not had the break of 5 months, you would have been due for ILR in July 08.

So considering you where granted FLR in Sept 07 till Sept 09.

I would take chance and apply in Dec 08, showing that you have completed a full 60 month with your FLR.

Saying all that I hope Amanda or John will pass some coment on this one.

Good Luck and I hope this helps.

.....Doctorterror....
Hmmm! I will let you guess the reason for the change in username! Jabi was taken up and the Moderator couldnt let me have it!

Plus the current debacle in the F1 training posts require a lot of time for me to contribute to this board.

I've always wondered, was it "doctor terror" or "doct error"? I don't know what would be worse actually.

Thanks for your replies...

I was busy searching for solicitors and came to know of two facts...

1) Only very few solicitors have slots on PCU
2) Though our applicaiton is represented by the Solicitor
on the same day service(PCU), he wont be given a chance to argue the case with the case worker.

Is the second fact true?
Please explain....
Thanks in advance

With a gap you should not use the same day service, as it will probably be rejected. We only use our slots for very straight forward applications.

get a home office' file and you can probably submit that file at the PEO. that provides them an explaination for your gap, I think.

No, really, anything that involves thought should be done by post.

I'm completing full 60 months on FLR ...by now

The gap was the delay made by HO.
Also I didn't leave the country on that gap and obtained the
FLR in country.

Does that make any valuable sense to go on same day
ILR?
