10 Year Residence

Post by farrukh_70 » Fri Dec 09, 2016 8:10 pm

Hi all

I came to UK on 12 Feb 2017. When does my 10 years' period completes (11 Feb 2017 or 12 Feb 2017. Technically It should be 11 Feb 2017 but some people say its 12 Feb 2017). My current visa is expiring on 13th Jan 2017 and I know I can apply 28 days before. What is the criteria for 28 days before? Is date of application included in 28 days? And Is date of completion (in my case either 11 or 12 Feb 2017 included in 28 days?
If....
* I consider 11 Feb then I have exactly 28 days left after 13 Jan 2017 but will they count 13th Jan as well? In that case the application will be 29 days before. OR
* If they consider 12 Feb for 10 years completion, in that case 28 days before will be 14th or 15th

Please reply. It would really be appreciated.
Many thanks

Thanks for the reply. I have read this guidance but couldn't establish start date of 28 days period relevant to my case.
Please help specifically to my scenario.

Why do 'some people' say you came on a different date. Do they know more about your arrival than you ???????

Thank you for the reply.
My current visa (Tier 1 Entrepreneur) is expiring on 13 Jan 2017. So should I apply for Tier 1 Extension or ILR and Home Office will give grace period of 2 days?

I am not a 'Guru' - I am just a common sense person. I would send a postal application before the expiry of leave if I was in your shoes !!!!

I would advise NOT to take the second option risk. You can apply for an extension of your T1E and vary after ur qualifying period to ILR. That way it is completely safe.
Opinion is researchedly mine!

best option is you apply entrepreneur and then vary application

don't take any risk

I have talked to couple of solicitors and both said even 10 years application should be ok as by the time case worker will start processing my 10 years would be completed. I am not sure what to do. I need to travel in March. Can we go on premium service after varying leave. If I apply for extension and vary leave after a week or so, would I be able to apply for premium service for 10 years application?
