FLR FP, FLR M application confusion . Please help !!!

Summery : Hi, I am from Bangladesh, My wife is British. I came here as a tier 4 student in 2009. I have never been a overstayer. Finished my uni degree, get married april 2014, Applied FLR FP SEPT 2014, got refusal letter Jan 2015, appealed FTT & UTT, all refused 24/112016, witin 14days applied new FLR FP application 03/12/2016.

(** my wife is earning £18600 and we believe we can meet FLR M the financial requirement in January ,2017 with her last 6month payslips )

Question : 1. Can I withdraw my FLR FP application and apply FLR M within 14 days ?
2. If I withdraw my FLR FP application and apply FLR M within 14 days , am I considered as a overstayer? In this case, am i breaking any immigration rules?
