Tier 2 and 55% increase in salary

Post by GondalUK » Mon Dec 12, 2016 3:08 pm

Hi all,

My Tier 2 VISA was issued in August 2015, and my intial commitment with employer was that they will incease salary once skill is proved and with the growth of business.

After 1 year, they increased my salary 55%. My employer or I never reported this to UKVI as my job responsibilties were the same, it was just the salary increase.

I want to ask from expereinced members, was it any mistake?
Should it be reported to UKVI?
Will it cause any problem for VISA extension or during ILR application if I don't report?

Thanks,
Masood

When in doubt, always report it, it takes 5 minutes.
Not too late, so there's still time.

Thanks for your reply, can you please guide me how to do this?

Is there any online form available where this can be done in 5 minutes?

Actually I just want to check if there is such requirement to update UKVI about increase in salary?

Experienced members, any opinion on this would help as increase in salary is normal every year.

Hi,

The employer should notify UKVI through SMS system for salary increase in 10 working days from the effective date if the increase in salary is not for all employees and specifically for the migrant on performance basis.

Thanks

Hi everyone,

I need your help and kind advice on my situation.

I was issued Tier 2 Visa after switching from Tier 4 in Dec 2015. I was employed as a Business Analyst SOC 2423(Management consultants and business analysts)

I was offered an initial salary of £23,000, following the completion of my probation period my salary was increased to £25,000 and this was accordingly reported to the UKVI via SMS.
It's been a year, and I have now been offered a promotion to a Lead Business Analyst, overseeing a team of 3 business analysts.

My salary will increase to £33,000, (32% increase). The core duties will remain the same, and the only added scope is that I will be responsible for growing a team of Business Analysts within the company/responsible for coordinating the efforts of multiple business analysts on any given project.

Will this be considered as technical change? I believe this still fall within the same SOC given that my duties & responsibilties remain the same? will I need a new application and to conduct RMLT as this may be viewed as a significant salary increase?

Thank you very much in advance.

Adam

Hi Adam,

Your employer needs to work out whether your job responsibilities will still fall within same SOC or different. If same SOC, then UKVI just needs to be notified of additional responsibilities and salary change.

But if it is different SOC, then it requires a proper RLMT and change of employment application.

It would be best if you would create a separate topic for your query as it is against the rules of this forum to raise a query in someone else thread.

Thanks

Thanks for responses from members. I have done some further research and following is what I could find from UKVI Sponsor guidance documentation:

15.7 You must report the following within 10 working days:

- if there are any significant changes in the sponsored migrant’s
circumstances, for example:

o a promotion or change in job title, or core duties, other than those
which need a change of employment application – the ‘Change of
employment’ section has more information on this

o a change of salary from the level stated on the CoS, other than
changes due to annual increments or bonuses

o a change of salary from that stated on the CoS due to maternity,
paternity shared parental or adoption leave, or a period of long term
sick leave lasting one month or longer

o the location they are employed at changes - this includes where a
sports player moves on loan

----------------------------

So it's clear from the above that salary increase must be reported to UKVI if that is not annual increments, I hope it will help someone with same concern.

Advice from experienced members would be appreciated:

The problem is that I am about 7 months late in reporting salary increase to UKVI. Shall I ask my employer to report it now?

Or alternatively my employer can say it was annual increase as the salary increase was done axtact after one year of my employment. Any advice?
